Decision:

Accordingly, the charge of careless riding against Mr Oliver was found proved.

Penalty:

Mr Oliver is suspended from the close of racing on Saturday, October 4th up to and including racing on Saturday, October 10th, 2020. This suspension follows a preceding one that Mr Oliver is about to begin.

Facts:

Following the running of Race 5 an Information was lodged by Mr Jones alleging a breach of Rule 638 (1) (d) in that Richard Oliver (IMBLAZE) allowed his mount to shift inward when not clear of TELLYAWHAT (A Mudhoo) which was dictated into the line of EMPRESS TZU HSI (D Hirini) which clipped a heel and blundered near the 1000 metres.

Submissions for Decision:

At the outset, Mr Oliver acknowledged that he understood the nature of the charge and confirmed that he did not admit the breach.

Mr Jones had Mr Goodwin explain the incident using the videos.

Soon after the start Mr Oliver, who started from near the middle of the field, made a move inwards towards the running rail but in doing so crossed in front of Mr Mudhoo when not the required distance clear. Mr Mudhoo was forced inwards where he took the line of Ms Hirini. As a result, she clipped the heel of Mr Mudhoo’s mount.

Ms Hirini and Mr Mudhoo gave evidence for the RIU.

Ms Hirini said she was racing comfortably in a position on the running rail when she received pressure from the horse to her outside. This resulted in her clipping a heel of TELLYAWHAT.

Mr Mudhoo told the Committee he was unable to relieve the pressure on Ms Hirini’s mount due to Mr Oliver coming across outside of him.

Mr Oliver defended the charge on the basis that his movement inwards was a slow, careful and progressive manoeuvre, rather than careless. He maintained that he was intially clear of Mr Mudhoo but Mr Mudhoo’s inexperience saw him hunt his mount up which led to the interference.

Reasons for Decision:

Mr Oliver placed the blame for the incident on the actions of Mr Mudhoo, who he said should not have hunted his horse up when he did.

The Committee’s opinion differs. Mr Mudhoo was entitled to his line of running, and he was not breaking any rules by urging his horse forward.

Mr Oliver made an error of judgement by mistaking his position in the field relative to Mr Mudhoo. Regardless of the manner in which he moved across he was not at any time the required distance clear of Mr Mudhoo’s mount. The rules of racing state that a rider must be their own, and one other length clear, before crossing in front of another horse. Mr Oliver did not fulfil that obligation by being only a bare length clear.

Submissions for Penalty:

Mr Jones told the Committee that Mr Oliver was about to begin a suspension following a charge of careless riding incurred on September 23rd.

The Stewards described the incident today as below midrange and submitted that a suspension was an appropriate penalty.

Mr Oliver reiterated that he had tried to be careful and reasonable when he moved across. He told the Committee he has been riding in New Zealand for 7 months after being unable to leave due to the Covid 19 lockdown. He has ridden in many countries and has had very few careless riding charges.

Reasons for Penalty:

The Committee made an overall assessment of the degree of carelessness as being below midrange. Mr Oliver simply erred in his judgement when he crossed too close in front of the mount of Mr Mudhoo. The consequences of his carelessness saw Ms Hirini clip a heel and lose ground.

Under normal circumstances the Committee would have imposed a suspension of 6 days, however we have had regard to the impact of Covid 19, and the restrictions this has placed on riders.

Balancing up all factors, it was the Committee’s opinion that a suspension of 4 days was appropriate.
