As Miss Jones admitted the breach we find the charge proved.
Penalty:
We grant Miss Jones' request to seek a deferment to her suspension as per Rule 1106(2).
Accordingly, Miss Jones had her license to ride in races suspended for a period to commence after racing on 27 December and conclude after racing on 1 January 2015 (4 North Island days).
Facts:
Following the running of race 5, Dunstan Championship Qualifier, an Information was filed pursuant to Rule 638 (1) (d). The Informant, Mr Oatham, alleged that Miss Jones angled her mount SILK CHARDONNAY outwards when not sufficiently clear of RASA LILA which was checked passing the 1900 metres.
Miss Jones acknowledged that she understood the nature of the charge, the Rule and confirmed her admission of the breach. Mr G Richardson assisted Miss Jones at the hearing.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Williamson identified on the video films that shortly after the start ZIZI crossed SILK CHARDONNAY and went to the lead. He said Miss Jones then directed her mount away from the rail and into the running line of RASA LILA when only ½ to ¾ of a length clear. He said this resulted in RASA LILA being checked losing ground after having nowhere to go.
Mr Richardson said in his opinion Mr Oliver the rider of ZIZI jammed on the brakes and Miss Jones had nowhere to go. He said it was a safety factor when Miss Jones came off the heels of ZIZI.
Miss Jones admitted to angling her mount away from the rail when not the required distance clear. She believed it was going to prevent an accident because her horse had ignorant racing manners.
Mr Oatham firmly disagreed with the fact Mr Oliver had reduced the speed out of the race. He reiterated that Miss Jones barely tried to restrain her mount and she moved out abruptly into the rightful line of Mr Colgan which caused him some grief.
Submissions for Penalty:
Mr Oatham produced Miss Jones' record which showed 1 previous breach under this Rule in the last 12 months. He added Miss Jones had a total of 354 rides to date with just the 1 suspension. He described Miss Jones’ record as good and assessed the level of carelessness as mid-range.
Miss Jones advised that she had upcoming engagements at Rotorua on 27 December, and sought a deferment to any proposed suspension. She submitted her record was very good.
Mr Richardson had nothing further to add.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented. We have adopted 5 riding days as the starting point in considering the term of suspension. The mitigating factors were Miss Jones' admission of the breach and her very good record in relation to this Rule. The aggravating fact was Miss Jones did not exercise the necessary care and attention when she shifted out sharply onto Mr Colgan’s mount which had to be checked losing ground. We assess the level of carelessness as low to mid-range and note Miss Jones was only ¾ of a length clear when angling her mount out.
After taking into account all the above factors we consider an appropriate penalty is a 4 day suspension.
