After taking all the above into account we impose a suspension of Mr Hills' license to ride in races which is to start after racing on 28 April and conclude after racing on 2 May 2012 (4 riding days).

Facts:
Following race 6 an information was filed pursuant to rule 638 (1) (d). The informant Mr Goodwin alleged that near the 500 metres Mr Hills permitted his mount THE INKEEPER to shift out when not clear of VOLKSWOOD (Mr J Waddell) which was checked.
Submissions for Decision:
Mr Goodwin demonstrated the video films and pointed out to the committee Mr Hills riding THE INNKEEPER ease his mount out nearing the 500 metres. In doing so he moved into the line of VOLKSWOOD (Mr J Waddell) when not sufficiently clear. This caused Mr Waddell to check his mount for 2 strides and lose momentum.
Mr Hills in admitting the breach had nothing to say when asked.
Submissions for Penalty:
Mr Goodwin stated that Mr Hills had a clear record in the preceding 12 months. He submitted the charge today should attract a 5 day suspension but left it to the committee to decide whether Mr Hills' record should influence the penalty.
Mr Hills said he had commitments up to and including 28 April and was intending to ride at the upcoming Marlborough meeting.
Reasons for Penalty:
The committee carefully considered all evidence and submissions. In Mr Hills' favour are his admission of the breach and his outstanding record. However these factors must be balanced along with the reasons as to why Mr Hills was charged. Mr Waddell received quite a severe check through Mr Hills taking his line when insufficiently clear. The committee finds his carelessness to be in the low to mid range. Normally as this breach was in a $25000 race on a premier day a suspension of 5 days would be imposed. However because of Mr Hills' outstanding record and his admission of the breach we reduce this suspension to one of 4 days.
