After taking all the above into account and having regard to the penalty guide's starting point of $500 for a first breach, we impose a fine of $300.
Facts:
Following race 9 The Davies Funerals 1600 an information was filed pursuant to rule 638(3)(b)(2). The informant Mr J Oatham alleged that Miss Schwerin rider of SECRETS ONLY used the whip excessively on her mount.
The rule reads: A rider shall not strike a horse with a whip in a manner or to an extent which is excessive.
Miss Schwerin acknowledged she understood the rule.
Mr Oatham demonstrated the video films pointing out Miss Schwerin strike her mount approximately 13 times prior to the 200 metres which he submitted was clearly outside the whip guidelines.
Miss Schwerin in admitting the charge said the films were self explanatory. She added that she was given instructions to be aggressive on her mount as it was inclined to be lazy.

Mr Oatham said Miss Schwerin had a clear record under this rule in the last 12 months but had been given a warning recently at Te Rapa. He submitted this breach was at the lower end.
Miss Schwerin had nothing to add regarding penalty and the same applied to Mr Chippendale.

The committee carefully considered all the evidence as submitted. Mitigating factors are Miss Schwerin's clear record under this rule and her admission of the breach. However Miss Schwerin's actions were clearly in excess of the whip guidelines with 13 continuous strikes without the required respite.The committee did regard the severity of the offence to be at the low end.
