Facts:
Following Race 2 (Hiremaster Premier) Mr Goodwin lodged an information with the Judicial Committee alleging a breach of Rule 638 (3) (b) (ii) in that Z Moki used her whip excessively prior to the 100m on Master Fin.
At the outset of the hearing, Ms Moki confirmed that she understood the Rule and that she admitted the breach. Licensed trainer, Mrs K Lawrence, was present as support for Ms Moki.
Mr Balcombe showed on the video where Ms Moki hit her mount, MASTER FIN, a total of 8 times before the 100m mark. Two of the 8 strikes were in succession.
Ms Moki agreed with the number of strikes as counted by Mr Balcombe.
Mr Goodwin described the breach as being in the low/mid-range and said some riders were still coming to terms with the new rules.
Ms Moki raised two points in response. She said she hadn’t been getting too many race day rides recently therefore the new whip rules were taking a while for her to get used to. In addition the Trentham straight is long and her horse was getting tired over the final stages.
Submissions for Penalty:
The Stewards’ submission was for a fine, in line with the penalty guidelines, for today’s offence.
Ms Moki was invited to make submissions on penalty but had nothing further to add.

This is Ms Moki’s first breach since all riders’ whip records were reset with the implementation of the new guidelines on October 7th 2019.
The Penalty Guide for Judicial Committees provides the following starting points for breaches of Rule 638(3) (b) (ii):
1st breach---$300
2nd breach---$500
3rd breach- suspension
The new limit is 5 strikes of the whip before the 100m mark which meant Ms Moki was 3 over the guidelines. The Committee ensured that Ms Moki was conversant with the new regime and was satisfied that she understood the revised guidelines. We took into consideration the fact that Ms Moki has had restricted race day experience since the whip changes. There were no aggravating factors necessitating an uplift from the starting point.
