Penalty:

Mr Aukett’s Jockey Licence was suspended from the end of Racing on 29 May 2021 through to the conclusion of Racing on 6 June 2021 (5 Riding Days) and Mr Aukett was fined $300.

Facts:

Following the running of Race 4 (Yara Fertiliser 1100), Information A14041 was filed with the Judicial Committee. It was alleged by the Informant that Mr Aukett allowed his mount to shift out near the 300m when not clear of DENY (L Hemi), AURORA STAR (T Yanagida) and CANCHERO (J Riddell).

Mr Aukett said that he understood the Rule, charge and confirmed that he admitted the breach.

Mr Goodwin showed all films and said that Mr Aukett rode with vigour and came out onto DENY who shifted out onto AURORA STAR with CANCHERO outside that runner being checked. He said that there was not any room for Mr Aukett to come out and that he was only ¾ length clear when shifting.

Mr Aukett agreed and said that he was guilty.

Submissions for Penalty:

Mr Jones said that Mr Aukett had one breach in the last 12 months, that being on 15 April 2021 when a suspension of 4 Riding Days and a fine of $250 was imposed for mid-range carelessness. Mr Jones placed today’s carelessness in the mid-range area.

Mr Aukett said that he was going well at the time and thought that he was clear but that he obviously was not. He added that he took full responsibility.

Reasons for Penalty:

The JCA Penalty Guide starting point for mid-range carelessness is a 5 Riding Day suspension and a fine of $500.

Taking into account that the carelessness was not less than mid-range, the admitted breach, that 3 horses suffered interference, along with Mr Aukett’s record, it was determined that a 5 Riding Day suspension and a fine of $300 was a suitable penalty.
