This Committee suspends Mr McNab's Riders Licence from the conclusion of racing on the 12th of December 2020 up to the conclusion of racing on the 23rd of December 2020. We calculate that to be 6 National Riding days being Counties, Ashburton, Otaki, Te Rapa, Gore and Matamata. In addition Mr McNab is fined the sum of $500.00.
Facts:
Following the running of the DON GRIFFITHS LIMITED DRILLING CONTRACTOR 1200 an Information was lodged by Stipendiary Steward Mr B Jones against Class A Rider Mr MJ McNab alleging that Mr McNab as the Rider of HONEY HONEY angled out passing the 250 metres mark when not clear of LUSTFUL LADY (Rider T Thornton) which was checked.
Rule 638(1)(d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr McNab was present at the Hearing and he acknowledged that he understood the Rule and that he admitted the breach.
Stipendiary Steward Mr A Coles demonstrated the incident by use of the race films. He identified both Mr McNab's and Mrs Thornton's horses and he showed where at about the 250 metres mark Mr McNab angled his horse out when trying to get a run and in doing so he came out several horse widths and on a sharp angle. He moved into Mrs Thornton's line and she had to abruptly check her horse.
Mr Coles used the side on film to show that Mr McNab was only about a length clear of Mrs Thornton's horse.
Mr McNab said that when he came out looking for a run he didn't see Mrs Thornton's horse and he acknowledged that Mr Coles had correctly described the incident.

Mr Jones said that Mr McNab had a very good record under this Rule and had not had any breaches in the last 12 months. He said that the carelessness was above mid range.
Mr McNab said the carelessness was not high end but he did concede that he had made a mistake.
When asked by the Committee if he was aware of the new Starting Point penalties for Whip Use and Careless Riding he said that he had only just become aware of them. He said that he had not been sent the written Guidelines by NZTR but someone had told him about them.
Mr McNab was asked if he wanted a deferment of his suspension but he said he wanted it to start immediately. The Riders for tomorrow's meeting at Te Rapa have been declared so the suspension would start from the conclusion of racing on the 12th of December.

The Committee reviewed the films of the incident. Mr McNab has angled out and come out quite a distance and because of his movement Mrs Thornton has had to sharply check her horse.
Mr McNab has admitted the breach but in view of the film evidence he had no other option. We do however give him credit for his excellent record under this Rule.
We have assessed the degree of seriousness as being in the mid to high range and for this we have adopted a starting point penalty of 7 National Riding days and we reduce this by one day because of Mr McNab's record. We are required under the new Guidelines to impose a fine of $500.00 on Mr McNab and accordingly we do so.
