As Mr Keast had admitted this breach it was found to be proved in accordance with Rule 1111(1)(d).

Penalty:

Mr Keast was fined the sum of $200-00.

Charge:

Alleged excessive use of the whip.

Facts:

Following the running of Race 6, the “Im Themightyquinn” Mobile Pace, an Information was filed by Stipendiary Steward Mr N. M. Ydgren against Open Horseman Mr J. T. Keast alleging a breach of Rule 869(2)(a) in that he used his whip excessively.

The charge reads as follows.
“I the above named informant allege that the above named Respondent committed a breach of Rule 869(2)(a) (in that) you used your whip in an excessive manner over the concluding stages when driving “Here Comes Dreamy”.

Rule 869(2)(a) reads as follows.
“(2) No horseman shall during any race:-
(a) use his whip in an unnecessary, excessive or improper manner.”

Mr Keast had indicated on the Information that this breach of the Rules was admitted, and Mr Ydgren advised that Mr Keast did not wish to attend the hearing.

Submissions for Decision:

Mr Ydgren gave evidence and used video coverage to show that Mr Keast had used his whip on about 20 occasions in the run home. The last 14 strikes had been almost continuous, with one slight pause.

Submissions for Penalty:

In relation to penalty Mr Ydgren advised that Mr Keast had no relevant previous breaches of this Rule, and as he had admitted this breach he submitted that a fine of $200-00 should be imposed.

Reasons for Penalty:

We took into account Mr Keast’s good record, and also that he had admitted this breach. The Penalty Guide recommends a starting point of a $300-00 fine, but taking into account all the mitigating factors we decided that a fine of $200-00 should be imposed in this case.
