Accordingly we were satisfied that POSTMANS DAUGHTER was denied a fair start and her chances were materially prejudiced. Therefore we declared the horse to be a non-starter.

Facts:

Following the running of Race 8, the Listed James Bull Rangitikei Gold Cup, the Stewards requested a ruling in relation to Rule 632 from the Judicial Committee in that “did POSTMANS DAUGHTER receive a fair start.”

632: If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a Race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord), the Judicial Committee may declare such horse to be a non-starter.

Submissions for Decision:

Race 8 was a 1600m Listed race and POSTMANS DAUGHTER started from barrier number 12. She was ridden by apprentice rider Mr Rory Hutchings.

Mr Goodwin showed the head-on and side view videos of the start of the race. The head-on view confirmed that all the gates opened correctly indicating no mechanical failure of the starting stalls. The side on view showed that POSTMANS DAUGHTER was slow away losing 5 – 6 lengths on the rest of the field. Mr Goodwin submitted that the reason the horse was slow away was because an attendant up beside the horse had hold of one of her ears and also the reins.

Mr Hutchings told the committee that while his horse was a little fractious in the starting gate she wasn’t too bad. Just before the gates opened she went to rear up, at the same time as an attendant grabbed her by the ear, but as the gates opened the attendant still had a firm hold on the ear which prevented her from jumping with the rest of the field. Mr Hutchings said that if she hadn’t been held he would not have lost the amount of ground that he did.

Mr Phillips said it was unfortunate timing in that the horse reared up at the same time as the gates opened but it was clear that an attendant was holding onto the horse preventing it leaving the stalls on terms with the other runners.

Mr Walker said that while POSTMANS DAUGHTER did not have a history of being slow away from the barrier she was very impatient in the gates and if she was “mucked around with she would fight you”. He said the attendant today probably grabbed her too tightly and as a consequence she began to rear up and then he still had a hold of her ear and the rein when the other horses jumped. Mr Hutchings added that he had ridden this horse approximately 10 times prior to today and while she could be awkward at the start she had never lost this amount of ground before.

Mr Goodwin submitted that POSTMANS DAUGHTER did not receive a fair start due to the attendant holding onto the horse longer than he should have resulting in her losing extra ground.

Reasons for Decision:

The committee carefully considered all of the submissions. POSTMANS DAUGHTER trailed the field out of the starting gates by a significant margin and yet ran home strongly to finish in fifth place. To declare the horse a non-starter we had to be satisfied that she was not slow away of her own accord. The head on film confirmed that all the gates opened on terms therefore we ruled out any mechanical failure. The committee then had to ascertain if POSTMANS DAUGHTER was the author of her own misfortune. The trainer and the rider both acknowledged that she does have a tendency to get fractious at the start and as a result is generally the last horse to be loaded into the gates. Today POSTMANS DAUGHTER could be seen to rear up as the gates opened however it was also clear that one of the attendants had a firm hold of her ear and also on the inside rein. It could be said that had POSTMANS DAUGHTER not been fractious she would not have required the attention of the barrier attendant therefore she was the author or her own misfortune. However it also cannot be disputed that as the gates opened she was still being held by the ear and the inside rein. This action, by the attendant, prevented her from leaving the starting gates on terms with the other runners and caused her to veer sideways upon leaving the gates.
