As Mr Waddell admitted the breach the Committee found the charge proved.
Penalty:
Accordingly, Mr Waddell had his license to ride in races suspended for a period to commence after racing on 27 October and conclude after racing on 8 November 2018.
Facts:
Following the running of race 10, Counties Cup Day 24th November 1600, an Information was filed pursuant to Rule 638(1)(d). The Informant, Mr Coles, alleged that Mr Waddell permitted his mount VERNANME to shift outwards forcing ETCH (L Innes) outwards into the line of OUR KATY CRUZ (B Grylls) which clipped a heel and blundered near the 400 metres.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Waddell said he understood the Rule and confirmed that he admitted the breach.
Mr Oatham demonstrated the incident using the available video footage. He identified that passing the 450 metres ANATOW (O Bosson) rolled out slightly when sufficiently clear and the run that Mr Waddell was attempting to take diminished. He said that Mr Waddell should have taken a hold of his mount but he elected to pursue a marginal run. He said there was not a “full run” available between ETCH and ANATOW when Mr Waddell tried to improve between those runners. He identified that Mr Waddell permitted his mount to shift out forcing ETCH outwards onto OUR KATY CRUZ (B Grylls). As a result that runner clipped a heel and blundered with Ms Grylls nearly dislodged from her mount.
Mr Waddell said that the video films were pretty clear and it was an unfortunate incident. He said that Ms Grylls put herself in a “peculiar position” and the gap closed on her. He said that he called out to Mr Innes to allow him room to shift out and his horse improved quickly. He stated that he was not aware Ms Grylls was racing behind Mr Innes’ mount.
Submissions for Penalty:
Mr Coles produced Mr Waddell’s record which showed 5 previous breaches under this Rule in the last 12 months. He advised the most recent suspension was 5 October 2018 when a 7 day suspension was imposed. He said that Mr Waddell has had 3 prior suspensions this year and his record was improving. He said Mr Waddell was a busy rider and his record was “not bad”. He described the level of carelessness as mid-range and a suspension in line with that would be appropriate.
Mr Waddell said that he had commitments on 27 October and any proposed suspension could start after that date. He said he felt lucky that Ms Grylls didn’t fall from her mount and submitted that he pushed the boundaries too far on his mount today. He believed that his careless riding record was improving. He said the level of carelessness was mid-range and given his admission of the breach a 7 day suspension would be an appropriate penalty.
The Committee advised Mr Waddell that the JCA Penalty Guide starting point for careless riding causing a fall is a 4 week suspension. Mr Waddell acknowledged this fact.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented.
It was evident when reviewing the video films that passing the 450 metres Mr Bosson’s mount shifted out 1 horse width when sufficiently clear. At that point Mr Waddell was attempting to take a narrow gap between ANATOW (O Bosson) and ETCH. Mr Waddell continued to ride his mount forward and in doing so made contact with ETCH. As a result that runner was forced out into the rightful running line of OUR KATY CRUZ. As a consequence that runner clipped a heel and blundered almost dislodging Ms Grylls. It is clear that Mr Waddell needs to exercise greater care when shifting ground in the future. The Committee deemed the level of carelessness displayed by Mr Waddell to be in the mid-range.
The JCA Penalty Guide starting point for mid-range carelessness is 8 days which was adopted.
The Committee rejects the assertions that Mr Waddell’s careless riding record is improving. We base this on the fact that this is Mr Waddell’s 2nd careless riding breach within the last 3 weeks and his 6th in the last 12 months. The Committee had regard for the fact that a reset for one of the careless riding charges will occur on 28 October 2018. We deemed Mr Waddell’s record to be sub-standard and this warranted a 1 day uplift in penalty.
We also note the JCA listing of penalties does not include Mr Waddell’s Rosehill Guineas suspension from March 2018 and the Stewards during their submissions inadvertently included an excessive whip suspension.
The only mitigating factor was Mr Waddell’s admission of the breach for which a 1 day reduction in penalty was applied.
After taking into account all the above factors the Committee considered that an appropriate suspension was 8 national riding days.
