Following the running of Race 8 (Storage NZ Mobile Pace) Information No. A10281 was filed with the Judicial Committee. It was alleged that Mr Peterson used his whip on more occasions than permitted under Clause( b) of the Use of The Whip Regulations.
Mr Peterson said that he understood the Rule, Charge and confirmed that he admitted the breach.
Mr Coppins identified the horse and driver on the film replays for those present at the hearing.
Informant Mr Mulcay said that Mr Peterson had struck his horse approximately 14 times in the run home.
Mr Peterson and Mr Butcher agreed that it was about 14 times.
Mr Butcher on behalf of Mr Peterson said that Mr Peterson had got a little excited and that the strikes were not over forceful.

Mr Mulcay said that Mr Peterson, whom is domiciled in Perth, had a very good record. He said that the JCA penalty starting point for such a breach is a fine of $300. He said that the Stewards would not have any objections to a discount being given due to Mr Peterson’s excellent record, admission of the breach and that he was driving away from his home State of Perth and that he is a Junior Horseman.
Mr Butcher said that Mr Peterson does have an excellent record as this was the first time he had been charged with a whip breach.
Mr Peterson confirmed that this was the first time that he had breached a Whip Rule.
Reasons for Penalty:
Taking all relevant matters into consideration regarding penalty, the Committee determined that a fine of $200 was an appropriate penalty.
