Mr Jones admitted the charge. The charge is proved.

Penalty:

Mr Jones is fined the sum of $150 and reminded of the need for him to be fully acquainted with the Rules of Harness Racing.

Facts:

Mr Renault, Stipendiary Steward, alleged that Mr Jones (BELMONT’S GREATEST) used his whip outside the confines of the sulky on several occasions during the run home.

Rule 869 provides as follows:
“(2) No horseman shall during any race: (c) project his whip outside the sulky or draw his whip further back than the sulky seat.”

Mr Renault showed videos of the conclusion of the race. He pointed out Mr Jones, driving BELMONT’S GREATEST, hit the discs of the sulky wheels on at least 3 occasions. This was inside the final 400 metres of the race.

Mr Jones confirmed that he had hit the discs. He said had driven primarily in Australia and was unaware that it was not allowed under the New Zealand Rules of Harness Racing.

Mr Orange confirmed Mr Jones was not long back from Australia and emphasised that the respondent was a junior driver.

Submissions for Penalty:

Mr Renault produced Mr Jones’ record, which was clear under this rule. He had 14 drives in New Zealand last season and 59 in Australia. The season before he had 215 drives in Australia.

Mr Renault stated that while no other driver was inconvenienced by the respondent’s actions, there was risk that the discs could shatter when hit with the whip.

The JCA Penalty Guide has a starting point of $200 or a 4-drive suspension.

Mr Jones accepted that was the starting point in the Penalty Guide.

Mr Orange submitted that a warning was appropriate, as Mr Jones had no previous breaches of this rule.

Reasons for Penalty:

Mr Jones can be seen clearly on the video to deliberately strike the discs on three occasions. There is a risk that the discs can shatter when hit with the whip. We understand that the reason this is done is that noise when the discs are hit is said to encourage the horse to try harder.

We take the $200 starting point in the Penalty Guide.

Mr Jones’ record is clear under this rule. The breach arose out of his ignorance that this practice was prohibited rather than being a deliberate decision to breach the rule. He has admitted the breach and has been co-operative with the Stewards.
