Mrs Allpress having admitted the charge, it is found proved.

Penalty:

The Committee granted Mrs Allpress’ application for a deferment, it being satisfied that she has riding engagements at the meeting of Auckland RC on 16 February 2019.

Mrs Allpress’ Jockey’s Licence (Class A) is suspended for a period from after the conclusion of racing on 16 February 2019, up to and including 23 February 2019 – 5 national riding days.

Facts:

Following the running of Race 2, Koru Care Charity Dinner – 22 March Rating 65, an information was filed by Stipendiary Steward, Mr J M McLaughlin, against Licensed Jockey (Class A), Mrs L J Allpress, alleging that Mrs Allpress, as the rider of MAJOR ISH CHOUX in the race, “allowed her mount to shift out crowding and checking LEULUAI (T R Moseley) passing the 100 metres”.

Mrs Allpress was present at the hearing of the information. She had indicated on the information form that she admitted the breach and she confirmed this at the hearing.

Rule 638 provides as follows:

(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:

    (d) careless.

Mr McLaughlin had Stipendiary Steward, Mr M R Davidson, show head-on, side-on and rear-on video replays of the relevant part of the race, passing the 100 metres. He pointed out Mrs Allpress, riding MAJOR ISH CHOUX, looking for a run to the outside of the leader, ATAAHUADREAMSRFREE (B B Hong). He then pointed out LEULUAI, ridden by Mr Moseley, to the outside of Mrs Allpress. Mrs Allpress tried to get into the gap, with Mr Moseley trying to give her room, but she came out “a wee bit too far”, Mr Davidson said. Mr Moseley was clearly crowded and had to take a hold of his mount, he said.

Mrs Allpress said that it was clear that she had come out. She was “travelling extremely well”, she said. She had looked for a run to her inside but was held up when the runner inside her improved. She could see a run coming to the outside of Mr Hong. She suggested that, as she had gone for the run, Mr Hong’s mount had moved out slightly. She had initially felt that the run was definitely coming, she said, but she conceded that Mr Moseley had been checked.

It was a very “competitive” finish and she had gone to the line without hitting her horse behind the saddle, she said. She had gone for a marginal run and was riding competitively, she said. The Committee noted that MAJOR ISH CHOUX had finished in 2nd placing, beaten by a head.

Submissions for Penalty:

Mr McLaughlin said that Stewards regarded the breach as being low-end and Mrs Allpress should be given credit for her usual “professional manner” in dealing with the Stewards.

He gave the Committee details of Mrs Allpress’ careless riding record – in March 2018, at Riccarton (4 days), in May 2018 at Riccarton (6 days) and in November 2018, at Auckland (5 days). This was a good record having regard to the number of rides that Mrs Allpress has, Mr McLaughlin submitted. Stewards had already discussed with Mrs Allpress that they would be opposed to a fine and submitted to the Committee that a 5-days suspension was appropriate.

Mrs Allpress asked that, if the Committee were to consider a 5-days suspension, it might consider making that a suspension of 4 days and a fine. Next Saturday, 16 February, she had picked up a ride for Chris Waller in the Avondale Guineas (Group 2, $100,000) and would be seeking a deferment until after that meeting. The following Saturday, 23 February, was the Group 1 sprint (Haunui Farm WFA Classic, Group 1 $200,000) at Otaki, she said. These were both “pretty important” meetings for her, Mrs Allpress said. She referred to a recent instance involving jockey, Opie Bosson, in which Mr Bosson had, she told us, been given a suspension and a fine of $1,000 to enable him to ride at the Karaka Millions meeting at the end of January. 

Reasons for Penalty:

The Committee agreed with Mr McLaughlin’s assessment of the breach as being low-end. Mrs Allpress had been riding competitively, her mount full of running, but she has misjudged the run that she thought was available to her between Mr Hong, who went on to win the race, and Mr Moseley whose mount appeared to be weakening and unlikely to finish in a dividend or stake bearing placing. Mrs Allpress only needed to wait a little longer for the run to become fully available.

The Penalty Guide starting point for a low-end breach is a 6-days suspension and we are satisfied that that is the appropriate starting point in this case. There are no aggravating factors requiring an uplift from that starting point. Mrs Allpress’ riding record was a good one, which we regarded as a neutral factor.

Mitigating factors are Mrs Allpress’ professional manner and her frank admission of the breach. We give her a discount of 1 day from the starting point for those factors.

We have noted Mrs Allpress’ submission regarding her wish to be able to ride in the Group 1 at Otaki on 23 February. We are not aware of the circumstances around the Bosson penalty to which she referred. Combined penalties of a suspension and a fine are rare and normally given by Judicial Committees only in exceptional cases, and the Bosson case may have been one of those. However, we do not regard Mrs Allpress’ missing a ride in the Group 1 at Otaki as involving exceptional circumstances, unfortunate as it may be.
