As Mr Ormsby admitted the breach we find the charge proved.

Accordingly, after taking all the above factors into account we impose a fine of $400.
Charge:
Following race 2 an information was filed pursuant to Rule 303(3)(c).The informant, Mr Williamson alleged that Mr Ormsby failed to make the weight (55.5kg) for SENATORIAL.
Facts:
Mr Williamson informed the committee that Mr Ormsby was 1kg over the carded weight for his mount SENATORIAL. He said half a kilo was permitted however with Mr Ormsby being 1kg overweight a replacement was sought.
Mr Ormsby told the committee that he was originally booked to ride WATERFORD in Race 2. However when it was scratched, he was engaged and committed to ride the stable mate SENATORIAL which was carded at the same weight. He conceded that on race morning he was struggling to make the weight.
Submissions for Penalty:
Mr Williamson produced Mr Ormsby's record which showed 5 previous breaches of this rule in the last 12 months. He said the latest occasion was on 1 January 2012 when he was fined $500 in a Group 1 event. Prior to this date, he received a $400 fine on 28 December 2011. Mr Williamson submitted a fine in the range of $300 to $400 would be appropriate, noting today's race meeting was an industry day.
Mr Ormsby admitted his record was not good, however pointed out to the committee that he had not breached this rule for two and a half months. He conceded when cross examined that he let himself down by having breakfast and lunch the previous day and couldn't get the last bit of weight off.

The committee carefully considered all the evidence and submissions presented. The mitigating factor is Mr Ormsby's admission of the breach. The aggravating factors are, this is Mr Ormsby 6th charge in the last 12 months and on this occasion he was 1kg over the carded weight.
We reminded Mr Ormsby that he previously advised the Judicial Committee on January 1 2012, that he would tell his manager not to book rides below 56kgs. Mr Ormsby is well aware of the consequences to connections and punters alike, when he could not accomplish his commitments.
