Decision:

In accordance with r 870(5) we relegate BARBERINO to behind CULLEN’S FINEST.

Amended placings are:
1st - 5 ITSNEWSTOME
2nd - 1 TULACH ARD
3rd - 12 NIGHT EMBERZ
4th - 4 CULLEN’S FINEST
5th - 10 BARBERINO
Dividends and stakes are to be paid accordingly. 

Facts:

Mr Allison, stipendiary steward, alleged that in race 10 BARBERINO, placed 4th by the Judge, broke with approximately 30 metres to run and was lapped on by CULLEN’S FINEST when it galloped across the line.  

Judge’s placings were

1st - 5 ITSNEWSTOME

2nd - 1 TULACH ARD

3rd - 12 NIGHT EMBERZ

4th - 10 BARBERINO

5th - 4 CULLEN’S FINEST

The margin between 4th and 5th was ¾ of a length.

Submissions for Decision:

Mr Allison read R 870(5) and demonstrated by reference to two video angles, the side-on and head-on, that BARBERINO had galloped some 30 metres before the winning post. The horse continued in an incorrect gait to the winning post and was lapped on by CULLEN’S FINEST. He stated that the official margin was ¾ of a length. He demonstrated by reference to the 50 metre pole that BARBERINO had not galloped in excess of 50 metres and as a consequence he was only seeking relegation behind CULLEN’S FINEST.

Mr Davidson, stipendiary steward, told this committee that Mr Negus, trainer of BARBERINO was content for Mr N Williamson represent him at the protest. Mr Williamson did not disagree that the horse was lapped on. In response to questioning by this committee, he acknowledged that BARBERINO had galloped free of interference when making a run in the passing lane.

Reasons for Decision:

We are satisfied that BARBERINO was in an incorrect gait when it crossed the line. It was lapped on by CULLEN’S FINEST. There is no suggestion that BARBERINO galloped as a consequence of interference.
