We therefore determined that Mr Muniandy’s Class A Jockey’s licence be suspended from the conclusion of racing today, Saturday 25 March until the conclusion of racing 8 April 2017 which encompasses the days racing at Southland on 1 April, South Canterbury on 6 April and Riccarton on 8 April 2017.
Facts:
Following the running of Race 8, the Valachi Downs South Island Thoroughbred Breeders Stakes Group 3, an Information was filed by Stipendiary Steward, Mr M Davidson, against Class A Licensed Jockey, Mr S Muniandy, the rider of NOT AVAILABLE, alleging he allowed his mount to shift in near the 1000m, placing MY CHINO, ridden by Mr G Jogoo and FLYING SARDINE, ridden by Mr R Yatim, in restricted room with LAAFFAIRE, ridden by Miss K Williams checking.
“(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless”
Mr Muniandy had indicated on the Information that this breach of the Rules was not admitted which he confirmed at the hearing. Mr Muniandy also agreed that he understood the charge and the Rule it was brought under.
Submissions for Decision:
Mr Davidson gave evidence and used video coverage, with the assistance of Stipendiary Steward Mr J McLaughlin, to show that approaching the 1000m, NOT AVAILABLE, ridden by Mr Muniandy, was racing in a 4-wide position with MY CHINO, ridden by Mr Jogoo, FLYING SARDINE, ridden by Mr Yatim and LAAFFAIRE, ridden by Miss Williams, racing on his inside. Mr McLaughlin pointed out Mr Muniandy shifting in from a 4-wide position to a 3-wide position with 3 horses established inside him. As a result, Miss Williams, riding LAAFFAIRE, and positioned on the rails ran out of racing room and had to check. Mr McLaughlin also pointed out Mr Muniandy eventually finishing up in a 2-wide position trailing DOUBLE BLUE, ridden by Mr D Bradley, whose horse had been racing fiercely and erratically, which caused some interference, just prior to this incident.
Mr Davidson called Miss Williams, rider of LAAFFAIRE, who stated that she was established on the rail, about 3/4 length behind Mr Yatim, when pressure from the outside runners gave her no option but to check out of her position. Mr Yatim, rider of FLYING SARDINE, gave evidence to the effect that he received pressure from the outside runners in this incident and was unable to give any relief to Miss Williams on his inner. Mr Jogoo, rider of MY CHINO, also gave evidence that he received pressure from his outside, that being Mr Muniandy, riding NOT AVAILABLE. He also stated that he was unable to relieve the pressure to the 2 runners on his inside.
Mr Muniandy stated that an earlier incident involving Mr Bradley's mount, DOUBLE BLUE, who was over racing and racing erratically, contributed to the incident. Mr Muniandy stated that Miss Comignaghi, riding MISS THREE STARS, had shifted off the rail, when racing immediately ahead of Mr Yatim and inside Mr Bradley on DOUBLE BLUE. He stated that this was the cause of the incident. Mr Muniandy also stated that he was always 4 wide throughout the incident and did not shift in or put pressure on the 3 runners on his inside.
Reasons for Decision:
The Committee carefully considered all oral and video evidence presented in this case. We were satisfied that Mr Muniandy was racing in a 4-wide position approaching the 1000m with 3 runners established on his inside. We were also satisfied, after hearing compelling evidence from the 3 riders on his inside and the conclusive video replays, that Mr Muniandy had shifted in when not clear, putting MY CHINO and FLYING SARDINE in restricted room and causing a check to LAAFFAIRE. We therefore found the charge of careless riding proved.
Submissions for Penalty:
Mr Davidson stated that Mr Muniandy’s penalty record over the previous 12 months showed a 3-day suspension at Riccarton on 9 November 2016 and submitted that his record could be described as good. He also stated that the breach was mid to low level carelessness with some mitigation due to the contribution of the over racing DOUBLE BLUE just prior to this incident. He said the only aggravating factor in this case was the status of the race being Group 3 and the stake payable $80,000. Mr Davidson submitted that a 3-day suspension be considered as penalty in this case.
Mr Muniandy stated that he did not seek a deferment and requested that any term of suspension begin immediately.

In determining penalty, the Committee took into consideration Mr Muniandy’s record, which we determined as good, as it showed only one suspension in the previous 12 months. We also took into consideration the Group 3 status of the race and the stake payable as an aggravating factor. In adopting the JCA Penalty Guide starting point of a 3-day suspension for a South Island rider, we determined that an uplift of 1 day to 4 days for the aggravating factor, was warranted. The Committee, however afforded Mr Muniandy credit for his good record with a discount of 1 day. We therefore determined that a 3-day suspension was an appropriate penalty in this case.
