Facts:

Mr Mulcay alleged that horse No 8 MONARCHY INVASION in race 1, The Corlett Trucking & Eltham Vets Handicap Trot, galloped over the final 30 metres and was lapped on by MADHUBALA and BEG FOR CHEVRON and breached the lapped on rule.

Judge’s placings were:
1st - MONARCHY INVASION
2nd - MADHUBALA
3rd - BEG FOR CHEVRON
4th - LITLEBITOFLOVE

The official margins between 1st and 2nd was half a length with a further half a length back to third.
 

Submissions for Decision:

Rule 870(5) states:
Notwithstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose reaches the finishing line and which is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such horse or its horseman, then (subject to r 869(8)) such relegation of the horse shall be at the discretion of the Judicial Committee.

Stipendiary Steward, Mr Mulcay demonstrated the available video footage of the concluding stages of the race, submitting that MONARCHY INVASION, when finishing strongly down the outside, broke approximately about 30 metres from the finish and continued in a gallop past the finish line. He submitted that in his view the horse lapped on both MADHUBALA, placed second by the judge and third placed BEG FOR CHEVRON, this was confirmed by the Committee from the print of the photo finish submitted as evidence by Mr Mulcay.

Mr Hackett, the driver and co-trainer of MONARCHY INVASION, represented the connections of that horse, and signed the Information that he did not contest the protest and notified Stewards he did not wish to be present at the hearing.

Reasons for Decision:

The Committee is satisfied that MONARCHY INVASION was in a gallop at the winning post, and was lapped on by MADHUBALA and BEG FOR CHEVRON.

MONARCHY INVASION has broken free of interference and in these circumstances we relegate MONARCHY INVASION to behind MADHUBALA and BEG TO CHEVRON.
