As Mr Quinn admitted the breach the charge was found to be proved.

Penalty:

Mr Quinn is suspended from riding at the Otaki meeting on Friday June 24th and in addition fined the sum of $250.00.

Facts:

Mr Goodwin lodged an information with the Judicial Committee alleging a breach of Rule 638 (3) (b) in that Mr Quinn used his whip excessively.

Mr Quinn acknowledged he understood the rule and confirmed his admission of the breach.

Mr Goodwin said Mr Quinn did most of the training of the horse MRS WICKET and knew the horse well. The films showed him in second last position near the rail on the turn. Mr Goodwin counted approximately thirteen strikes of the whip prior to the 200 metres. Although these were not continuous strikes Mr Quinn did not ride within the guidelines which clearly say there should be a respite of six strides where a rider puts their hands back on the reins.

Mr Quinn had no dispute with the interpretation of the videos. He confirmed that he knew the horse well and said while it had ability it was a “lazy” horse who responded to the whip. He said that he did not judge his strides very well.

Submissions for Penalty:

Mr Goodwin said Mr Quinn had no charges under this rule within the last 12 months and possibly longer. He had admitted the breach straight away and had merely made an error, not being conscious of the way he was using the whip.

When asked for his submissions on penalty Mr Quinn said he would prefer a suspension over a fine. The Committee was advised that Mr Quinn has employment in addition to his riding career.

Reasons for Penalty:

The committee notes that the Penalty Guide for Judicial Committees provides a starting point of a $500 fine or a two day suspension. It is recognised that Mr Quinn, as a high-weight and jumps rider, has fewer opportunities than that of a flat rider however excessive use of the whip will not be tolerated and any penalty must act as a deterrent.

We had regard to the severity of the breach and placed this as in the midrange. Mr Quinn was told that it was not acceptable to ride outside of the guidelines just because he considered his horse to be lazy. Taking into account Mr Quinn’s admission of the breach and other recent penalties it was our opinion that a suspension of one day and a monetary penalty of $250 was appropriate. Mr Quinn told the Committee that he did not have any rides at Te Aroha on Sunday June 19th. The next race day with eligible races was Otaki on June 24th.
