Decision:

The committee accordingly found the charge of careless riding proved.

Penalty:

Accordingly, we impose a suspension on Ms Wenn, which will commence after racing on 3rd January 2012 and conclude after racing on 7th January 2012(4 days).

Charge:

Following race 8, an information was filed pursuant to Rule 638(1) (d). The informant, Mr Oatham, alleged that Ms Wenn permitted her mount, KAFAFEL, to shift inwards near the 1100 metres, crowding the running of ROSSITA (A Forbes) and BILLIES LATER (M Cropp).

Facts:

Mr Robinson demonstrated the incident using the head on and side on films. He pointed out to the committee, Ms Wenn was racing in a 4 wide position at the 1100 metre mark, when she allowed her mount to shift in when only 1 and ¼ lengths clear. This resulted in 2 runners to her inside being awkwardly placed on the heels of her mount.

Ms Wenn had no questions of Mr Robinson’s interpretation of the video films.

Mr Oatham then called Mr Forbes as a witness. He said that he had received some crowding from Ms Wenn’s mount, which was racing on his outside. He said that Ms Wenn was a length clear at the time of the incident. Prior to the crowding, he said that his mount was racing in a tractable manner.

Ms Wenn had no questions of Mr Forbes' evidence.

Mr Oatham then called Mr Cropp as a witness. He said that he suffered interference, which resulted from pressure coming from his outside. He said that Ms Wenn had moved in onto Mr Forbes, who in turn placed pressure on his mount. He believed that Ms Wenn was just a length clear when she shifted ground. He said that his mount was racing okay prior to receiving the pressure, however once he received the bump, his mount started to over race.

Ms Wenn asked Mr Cropp, if she had been 2 lengths clear, would his mount still have over raced? Mr Cropp said yes, and believed his mount got a fright from the bump.

Ms Wenn said that she believed Mr Forbes may have anticipated her shifting in earlier, as she spent a lot of the back straight looking in, prior to shifting inwards. In her own admission, Ms Wenn told the committee that she was not 2 length’s clear when shifting in. She believed that if Mr Cropp’s mount had not over raced, nothing would have happened.

Ms Wenn called Ms Thornton as a witness. Ms Thornton told the committee, that Mr Cropp had concerns in the barrier, that his horse was difficult to control. Ms Thornton, who was racing on the inside of Mr Cropp, said that in her opinion, Mr Cropp instigated the problem, which caused 2 horses to be crowded and checked.

Mr Oatham, in summing up, said that Ms Wenn was not the required distance clear when moving in.

Ms Wenn, in summing up, said that Mr Cropp’s horse made the interference look worse than it should have been.

Reasons for Decision:

The committee carefully considered all the evidence and submissions as presented. The films clearly showed that Ms Wenn was only a bare length clear when she moved in. This resulted in Mr Cropp’s mount receiving a bump and it then started over racing.

Submissions for Penalty:

Mr Oatham produced Ms Wenn’s record, which showed she had a clear record in the last 12 months. He submitted the level of carelessness was low range and the racing manners of Mr Cropp’s mount was a mitigating factor in Ms Wenn’s favour. However, he said that Ms Wenn was not the required 2 lengths clear, and submitted a suspension at the bottom end of the scale would be appropriate.

Ms Wenn told the committee that she had firm commitments up until January 3. She confirmed to the committee that she rides in the North Island.

Reasons for Penalty:

The committee carefully considered all the evidence and submissions as presented. The mitigating factors are Ms Wenn’s excellent record, and the level of carelessness, which we assess as low range. However, this has to be balanced against the fact that Ms Wenn was only a bare length clear, when shifting in.
