Accordingly, the protest was dismissed and judges' placings were allowed to stand. We directed that all dividends were to be paid accordingly.
Facts:
Following Race 1 a protest was lodged pursuant to Rule 642(1).
Mr J Parkes alleged that MARECHAL or its rider, placed 1st by the Judge, interfered with the chances of REAIS, placed 2nd by the Judge. He alleged that MARECHAL interfered with the chances of REAIS over the final stages.
Judges' placings were:
1st - MARECHAL (5)
2ND - REAIS (2)
3rd - TWILIGHT GRANITA (7)
The official margin between 1st and 2nd horses was a short neck.
Submissions for Decision:
Mr Parkes showed the head-on film and said that half way down the straight, his line of running had been taken when MARECHAL moved inwards crowding him. He said that he had to stop riding for 2-3 strides, straighten his mount up and as a result lost momentum. Ms Frost showed the rear view film and said that her horse REAIS could not be ridden out over the final 30 – 50 metres of the race.
Mr McDonald, the rider of MARACHEL, said that he always had the other horse covered, the interference was very minor and over the last 25 metres of the race he was drawing away from REAIS. He said that Mr Parkes had room to his inside and could have used the whip in his other hand. Mr Allen added that MARACHEL had come from behind REAIS and said that the interference did not affect the final placings.
For the Stewards, Mr Oatham said that there was some crowding between the horses over 5-6 strides and REAIS may have been impeded “to a degree”. He asked the committee to look at the manner in which both horses got to the line. He said that the Stewards were not convinced that without the crowding, REAIS would have beaten MARACHEL, therefore they would not support upholding the protest.
Reasons for Decision:
The committee very carefully considered all of the evidence and reviewed all the available video angles of the incident.
It was obvious that interference occurred between MARACHEL and REAIS over the final stages, when MARACHEL moved inwards and made contact with REAIS. Of particular significance was the fact that MARACHEL came from a position behind REAIS and had headed that horse prior to any interference occurring. MARACHEL then went on to finish the race strongly drawing away from REAIS. The interference did prevent Mr Parkes from using the whip for several strides however Mr McDonald was also only riding hands and heels at the time. Taking into account the short neck margin we were not satisfied that, free of interference, REAIS would have beaten MARACHEL.
