Benromach was disqualified pursuant to Rule 1003(2) and the judges' placings amended as follows:

1st     8    Phoebe Gladiator

2nd    5    Johnny Springfield

3rd    7     Loki Brogden

4th     9    Guadaloupe

5th     4    Avalon Sunset

Authority was given to pay on the amended placings.

Facts:

Following the running of race 4, "The Rotary Cambridge Charity Fundraiser Junior Drivers Handicap Trot", Stipendiary Steward Mr S Wallis laid an information lodging a protest against the third placed horse number 3 BENROMACH, driven by Junior driver Mr K Marshall on the ground that it had paced the final 200 metres.

Judges' placings for the race were:

1st     8    Phoebe Gladiator

2nd    5    Johnny Springfield

3rd    3     Benromach

4th     7     Loki Brogden

5th     9     Guadaloupe

Owner/Trainer Mr G Martin appeared for the Hearing and advised the Judicial Committee that he did not contest the protest.

Stipendiary Steward Mr Wallis referred the committee to footage of the concluding stages of the race and identified Benromach entering the final straight in the trail and then moving into the passing lane.  In doing so the horse faltered momentarily before breaking from a trot into a pacing gait.  It continued to race in its incorrect gait through to the finish line finishing in third place.

Submissions for Decision:

Mr Wallis confirmed that Benromach had raced in its incorrect gait for approximately 200 metres in breach of the Breaking Horses Regulations and sought disqualification.

Mr Martin agreed that disqualification was the logical outcome in the circumstances.

Reasons for Decision:

It was clear to the committee that Benromach had paced the final 200 metres or so of the trotting race and clearly had not regained its proper gait in breach of The Breaking Horses Regulations.
