Mr Buchan indicated on the information that he admitted the breach and did not wish to be present at the hearing of the matter.

The charge is thus found to be proved.

Penalty:

Having regard to the defendant’s record and his admission of the breach, we impose a fine of $200 and request that Mr Allison remind the defendant of his professional obligations.

Charge:

Mr Allison, stipendiary steward, alleged that with approximately 1700 metres to run Mr C Buchan (BANKERS MOMENT) shifted ground outwards forcing SUNNIVUE TED (Mr T Williams) over extra ground when SUNNIVUE TED had improved outside the wheel of BANKERS MOMENT.

Facts:

Mr Allison had Mr Wallis, stipendiary steward, demonstrate the incident on 2 video angles. This showed that Mr Buchan, who was racing one out, had come out quite quickly but had left his move too late, in that Mr Williams who was improving rapidly, was ahead of the cart of Mr Buchan when the defendant moved out. Mr Williams was forced to race 4 wide.

Submissions for Penalty:

The defendant has one breach of the push out rule this season. This was in January last at Oamaru when he was warned by the judicial committee.
Mr Allison stated he believed the incident was at the lower end of the scale and that a fine was appropriate.

Reasons for Penalty:

We concur with Mr Allison that the breach is towards the lower end of the scale. Mr Buchan has simply been caught out by the speed with which Mr Williams’ horse was progressing.
