Facts:
Following the running of Race 7, an information was filed by Stipendiary Steward, Mr S Renault, against Junior Driver Miss A Cameron alleging that “A Cameron (QUARTERBACK) drove carelessly near the 550m by shifting ground outwards when not entitled to resulting in MARTIN JOHN being placed in restricted room and checked”.
Miss Cameron signed the Information denying the breach, and she confirmed to the Committee she was conversant with the Rule.
Miss Cameron was assisted at the hearing by Open Driver, Mr M Purvis.
Rule 869(3) (b) provides as follows:
(3) no horseman in any race shall drive:
(b) carelessly.

Mr Renault used the race video to identify Miss Cameron driving QUARTERBACK racing 5 back on the fence at approximately the 600m. He showed Mr Close (MARTIN JOHN), following Miss Cameron, shift out from the fence and pointed to Miss Cameron moving out into the running line in front of him. Mr Renault said prior to these moves Mr R May (KINGDOWN ATOM) who was racing to Miss Cameron’s outside, pushed out into the 3 wide line forcing SAFE ZONE (D Roberts) 4 wide.
He said from this point Miss Cameron shifted out which she was not entitled to do, as Mr Close was positioned there and because Mr Roberts was endeavouring to find Mr May’s back Mr Close was tightened between runners, contact was made and MARTIN JOHN scrambled for a stride or two.
Mr Renault then called Mr Close as a witness and under questioning recalled easing out three wide from behind Miss Cameron and receiving pressure from Miss Cameron. Mr Close said he was yelling because he could see Mr Roberts angling on to Mr May’s back and Miss Cameron doing the same. He thought he was about to “hit the deck” as he had nowhere to go. Mr Renault asked Mr Close if contact had been made from the inside. After viewing the replay Mr Close admitted he was contacted by both the inside and outside.
Mr Purvis asked Mr Close did he believe Mr Roberts had maintained his line 4 wide or was he angling down onto Mr May’s back. Mr Close conceded Mr Roberts had moved inwards but thought Miss Cameron had contributed more to the check he received.
Mr Purvis, on Miss Cameron’s behalf, stated Mr Roberts didn’t maintain his line but angled inwards on to Mr May’s back. He said Miss Cameron had started a move to the 3 wide position but had only barely moved out of the 2-wide line before straightening.
Reasons for Decision:
After retiring and then revisiting the films of the incident the Committee concluded there was no doubt Miss Cameron has placed pressure on Mr Close by attempting to shift out to the 3 wide running line.
Equally there is no doubt Mr Roberts has shifted inwards at the same time and contributed to Mr Close receiving his check.
Both Miss Cameron and Mr Roberts could clearly be seen straightening their respective horses as the interference happened.
Mr Close who was in the best position to judge was clear he was hit from both sides although the best video could not show any contact from Miss Cameron, only from Mr Roberts.
Hence the Committee were not satisfied, on the evidence of the parties and the films, that Miss Cameron was solely responsible for the interference to MARTIN JOHN.
