Mr Butt admitted the breach, which we thus find proved. 

Penalty:

We fine Mr Butt the sum of $275 and remind him of his obligations under Rules of Harness Racing. 

Charge:

Mr Allison, stipendiary steward, alleged that Mr R Butt, the junior driver of OHOKA BOSTON used his whip excessively over the final stages of the race. 

Facts:

Mr Allison demonstrated on the video that as he turned for home Mr Butt commenced to use the whip. He counted some 21 strikes from that time until the horse crossed the line. He acknowledged that the defendant had broken up the strikes, but was concerned as to their frequency. He accepted that the defendant had only just breached the rule and believed that had he been more judicious in his use of the whip as the horse rounded the bend for home, he would not have been in breach of the rule.

Mr Jones spoke on the defendant’s behalf and emphasised the breach was low end and that the defendant had interrupted his strikes.
 

Submissions for Penalty:

Mr Allison produced the defendant’s record, which showed two breaches in the previous 12 months: a fine on 13 February and a seven-day suspension on 7 June. He submitted a fine was appropriate on this occasion and acknowledged that the defendant appeared to have attempted to change his whip action during the season’s racing.

Mr Jones reiterated the breach was low end and, that as there was a horse very close to the defendant’s horse most of the way up the straight, the defendant had continued to use the whip.
 

Reasons for Penalty:

We accept the breach is not at the high end, and note that there was some respite in the use of the whip. But we note had the defendant been more circumspect with his use of the whip at the turn, he would not have fallen foul of the rule when he was being challenged by another horse all the way up the straight.

Mr Butt has 2 previous breaches of the rule in the past 12 months, the latest being on 13 February when he was fined. We are pleased to hear that Mr Butt has been mentored since he had a spate of breaches of this rule and appears to have heeded that advice. We also take into his ready admission of the breach and the fact that he is a junior driver.
