As the breach was admitted we find the charge proved.

Penalty:

After taking all the above into account and with the knowledge that Mr Cameron will be serving a suspension also arising from this race  concluding on 17 March we impose the following:  under the provisions of 1106 (2) we impose a suspension on Mr Cameron from riding in races which is to start after racing on 17 March and conclude after racing on 23 March (7 days).  In addition we impose a fine of $1200.

Facts:

Following race 9 an information was filed pursuant to rule 638(1)(d).  The informant Mr C George alleged that near the 1800 metres Mr M Cameron allowed his mount ROCK'N'POP to shift in when not clear of CARRICK (Mr L Innes) which was hampered.  This caused CARRICK to move in crowding ROAMIN (Mrs T Thornton) who was checked.

Submissions for Decision:

Mr Oatham demonstrated the video films which showed ROCK'N'POP racing in a 3 wide position near the 1800 metres.  At this stage CARRICK was racing approximately 1 length behind ROCK'N'POP and on his inside.  Behind him and racing on the rail was ROAMIN.  Mr Oatham then showed Mr Cameron shifting in from a 3 wide position to one of 2 wide.  He stated Mr Cameron was a bare length clear when moving in which resulted in quite a severe check to Mr Innes and crowding to Mrs Thornton. 

Mr Cameron in admitting the breach said he was aware of 2 runners on his inside but thought he was clear when moving in.  He added his mount was a colt and somewhat wayward.

Submissions for Penalty:

Mr George told the committee Mr Cameron had incurred 3 careless riding charges in the last 12 months.  He reminded the committee this was a Group 1 race and submitted Mr Cameron's carelessness on this occasion was at the high end.  He stated a suspension of 6 - 8 days and a fine of $1000 to $2000 would be appropriate.

Mr Cameron said he had commitments up to and including 10 March and he rode throughout the country.

Reasons for Penalty:

The committee carefully considered all evidence and submissions.  Mitigating factors are Mr Cameron's admission of the breach and his good record for the number of rides he has.  In aggravation this interference occurred in a Group 1 race with 2 horses being affected by Mr Cameron moving in when insufficiently clear.  A consequence which the committee considered, was, that one of the horses affected was CARRICK which finished a head behind ROCK'N'POP and in 3rd place at the finish.  On this occasion the committee finds Mr Cameron's carelessness to be at the high end.
