As Mr Turner admitted the breach we found the charge proved.

Penalty:

Taking into account Mr Turner’s upcoming riding commitments we suspend his license from the close of racing on Sunday October 21st up to and including racing on Saturday October 27th.

Facts:

Following the running of Race 3 (Black Bull Woodville 1100), an Information was lodged by Mr D Balcombe alleging that D Turner (NEBRASKA) permitted his mount to shift in near the 900 metres when insufficiently clear of HUGO THE BOSS which was checked.

Mr Balcombe had Mr Williamson explain the incident with the assistance of the available video angles. He showed Mr Turner racing to the outside of HUGO THE BOSS before commencing to shift in when not sufficiently clear of that runner. Mr Williamson estimated Mr Turner was only ½ - ¾ lengths clear when he crossed. The check resulted in HUGO THE BOSS losing 1½ - 2 lengths of ground and its rightful line of running in the race.

Mr Williamson said NEBRASKA was laying in and not an easy ride for Mr Turner however he should have stopped riding it forward to protect the riders to his inside.

Mr Turner agreed that NEBRASKA was laying in and explained he could be a difficult horse to ride on race day. He said he had galloped NEBRASKA numerous times in order to get to know the horse better. Mr Turner acknowledged he had not been sufficiently clear of HUGO THE BOSS when he moved in but thought Tim Johnson was easing back on HUGO THE BOSS to allow him room.

Mr Balcombe presented Mr Turner’s riding record for breaches of the careless riding rule over the last 12 months:

19/4/18 - Woodville 5 days
23/12/17 - Manawatu 6 days

He said the Stewards placed the degree of carelessness in the low-mid range. Although NEBRASKA was laying in prior to the incident Mr Turner should have done more to straighten his mount. Mr Balcombe submitted that a term of suspension was an appropriate penalty.

Mr Turner declined to make any penalty submissions but advised of riding commitments through until Sunday October 21st at Otaki.

Reasons for Penalty:

In coming to a decision on penalty the Committee considered all submissions. It was clear from the films that NEBRASKA was laying in prior to the incident and we heard from both the Stewards and Mr Turner that the horse is difficult to ride. Commendably, Mr Turner has spent some time away from raceday trying to understand the horse better.

Where Mr Turner erred today was in not taking corrective action sooner when NEBRASKA began to run in. He continued to ride forward, under the misunderstanding that Mr Johnson was easing back on HUGO THE BOSS. The resultant check to HUGO THE BOSS saw that runner lose significant ground.

Factoring in the racing manners of the horse the Committee placed the overall degree of carelessness in the low range.

Mitigating factors were Mr Turner’s good record and his ready admission of the breach.

The Committee determined that an appropriate penalty was one of 5 riding days.
