Decision:

Taking all these factors into account the committee is not satisfied that NORDIC KNIGHT would have beaten IMPEL if interference had not occurred.  Therefore the protest is dismissed and the judges places shall stand.

We order the payment of stakes and dividends accordingly.

Facts:

Following race 4 a protest was lodged pursuant to rule 642.  Mr N Tiley said IMPEL, placed 1st by the judge, interfered with the chances of NORDIC KNIGHT, placed 2nd by the judge.  This interference was alleged to have occurred in the final straight.

The judge's placings were as follows:

5   IMPEL    first

6   NORDIC KNIGHT   second

2   SINGLE ACT   third

The official margin between first and second was a nose.

Submissions for Decision:

Mr Tiley demonstrated the video films and asked the committee to take into account there was only a nose between the 2 horses at the post with the interference occurring close to the finishing line.  He said NORDIC KNIGHT had its momentum affected and believed he would have got the better of IMPEL without any interference.  In answer to a question from the committee Mr Tiley conceded the bump occurred 3 to 4 strides before the line.

Miss Spratt said she did have to stop riding and believed she had IMPEL covered when she received a bump. She submitted that the nose margin indicated she should have won the race.

Mr Cole said Mr Colgan did not stop riding and NORDIC KNIGHT was taken off stride.

Mrs Murdoch conceded IMPEL had moved out but only touched NORDIC KNIGHT right on the post.

Mr Olson said NORDIC KNIGHT did head IMPEL at the 250 metres but his horse had come back to win the race.

Mr Alderslade said IMPEL moving out was irrelevant as he was clear and Miss Spratt did not stop riding.  He further stated IMPEL had come back after being headed by NORDIC KNIGHT and the alleged interference only occurred right on the line.

Mr Colgan conceded the 2 horses rubbed together 1 stride before the winning post.  He stated NORDIC KNIGHT was never going to beat IMPEL.

Mr Neal, when asked for his assessment, said both horses were hotly contesting the lead when IMPEL did shift out but NORDIC KNIGHT also moved in slightly.  He said the bump was minor and it occurred very close to the finish.

Mr Tiley, in summing up, reiterated Miss Spratt did stop riding and again emphasised the nose margin at the post.

Reasons for Decision:

The committee carefully considered all evidence and submissions and reviewed the relevant films several times.  These clearly showed that minor contact did occur between the 2 horses at the 20 metre mark.  The committee considers this to be more of a minor brush with NORDIC KNIGHT maintaining its line and not losing momentum.  The other relevant factors were that Miss Spratt continued to ride forward to the line with the brush occurring approximately 3 strides from the post.
