As the breach was admitted we find the charge proved.

Penalty:

Accordingly after taking all the above into account and under provisions of rule 1106 (2) (a) we suspend Mr Bosson from riding in races which is to start after racing on 6 October and conclude after racing on 13 October 2012 (4 days).

Facts:

Following race 3 an information was filed pursuant to rule 638 (1) (d).  Mr Oatham alleged that Mr Bosson permitted his mount KING DAN to shift outwards near the 200 metres forcing BUCKLES outwards crowding TATTS onto COUNT ISTI and STRENUA with COUNT ISTI being checked.

Submissions for Decision:

Mr B Jones demonstrated the video films which clearly showed Mr Bosson allowing his mount to move out approaching the 200 metres.  He submitted that Mr Bosson was not sufficiently clear of BUCKLES when moving out and this resulted in crowding 3 runners on his outside. 

Mr Bosson in admitting the breach submitted that BUCKLES was laying in slightly contributing to the incident.

Submissions for Penalty:

Mr Oatham told the committee that Mr Bosson had a clear record in New Zealand in the last 12 months although he had been overseas for a considerable time.  He said today's breach caused a concertina effect on several horses with Mrs Thornton having to check her mount COUNT ISTI.

Mr Bosson said he had commitments up to and including 6 October.

Reasons for Penalty:

The committee carefully considered all submissions and evidence as presented.  Mitigating factors are Mr Bosson's admission of the breach and his very good record.  However 4 horses were inconvenienced through Mr Bosson moving out when not clear.  We do find the breach to be at the low end.
