Following race 5 an information was filed pursuant to rule 638 (3) (b). The informant Mr George alleged that Mr J McDonald used the whip excessively on his mount LADY KROVANH.
Submissions for Decision:
Mr George demonstrated the video films which clearly showed Mr McDonald striking his mount 10 times before the 200 metres without giving the required respite.
Mr McDonald said he had a memory lapse and misjudged the number of strikes he had given his mount.
Submissions for Penalty:
Mr George said Mr McDonald had 1 whip charge on 1 December 2011 and asked the committee to take into account the Group 2 status of this race. He submitted a penalty of $200 - $300 would be appropriate.
Reasons for Penalty:
The committee considered the submissions and evidence as presented. While the amount of strikes Mr McDonald had given his mount was not over excessive this breach occurred in a Group 2 race. Also relevant is Mr McDonald's recent breach under this rule.
