Penalty:

Taking into account Mr Singer's riding engagements he is suspended from the close of racing on Saturday 23 April up to and including Thursday April 28th. This incorporates the Auckland (25th), Counties (27th) and Marlborough (28th) meetings.

Charge:

Following Race 3, Mr C Singer was charged with careless riding under Rule 638(1)(d). The information stated that passing the 700m, C Singer permitted his mount DARCEEDUNCAN to shift in when not clear of FINITO (J Gillies) which was checked.

Facts:

Mr Goodwin showed the head-on, side-on and back-on films of the incident which occurred when passing the 700m. Prior to this point, Mr J Gilles’ mount (FINITO) has been established to the inside of DARCEEDUNCAN, and was entitled to be where it was. The head-on view clearly showed Mr Singer’s mount, DARCEEDUNCAN, move inwards when passing the 700m when not clear of FINITO, who as a result of this movement has had to be abruptly checked. Consequently, FINITO has gone back onto Mr M Gillies’ mount (WILBUR), who has had to steady off FINITO’s heels.

The side-on film showed the amount of ground FINITO loses as a result of the incident, however, stewards identified that Mr J Gillies confirmed his mount was tired at this point. Nonetheless, Mr Singer has moved his mount inwards when not sufficiently clear.
Mr Singer stated that he had nothing further to add.

Submissions for Penalty:

Mr Goodwin submitted that Mr Singer has a perfect record, having ridden for 4 years without a period of suspension. It was the stewards submission that the level of carelessness was in the mid-range and that a 4 day suspension as a result of this interference would be warranted.

Mr Singer, when addressing the committee on penalty, stated that he rides at all northern meetings and submitted that a 4 day suspension would be fair. He submitted that due to riding engagements he would like any period of suspension to commence after the close of racing on Saturday 23 April.

Reasons for Penalty:

The committee considered all of the submissions put before it. It was our opinion that a period of suspension was an appropriate penalty on this occasion. Mr Singer commenced an inward movement, when not sufficiently clear of FINITO, resulting in a check to Mr J Gillies’ mount. While in mitigation this incident did not appear to cost FINITO a dividend-bearing placing, Mr Singer nonetheless, did not exercise the duty of care expected of all riders.  The committee adopted a starting point for suspension of five days but gave credit to Mr Singer for his early admission of the breach, and his exemplary riding record; having no charges during the previous four years. For these reasons we placed his carelessness within the mid-range and imposed a three day suspension.
