ENHANCE YOUR CALM was therefore disqualified from its 3rd placing.

The official placings became:

1st - OSCAR BONAVENA

2nd - MAJESTIC MAN

3rd - DESTINY JONES

4th - TEMPORALE

5th - GERSHWIN

Authority was given for dividends and stakemoney to be paid in accordance with the amended placings as above.

Facts:

Following the running of Race 8, the GROUP 1 TURF BAR TROTTERS FLYING MILE MBL TROT 1609M, an Information was lodged by Mr Mulcay instigating a protest. Mr Mulcay alleged that the horse ENHANCE YOUR CALM 'broke in excess of 50 metres in the final 200m'. ENHANCE YOUR CALM was placed 3rd by the Judge.

Mr Mangos, the driver of the horse and representing the connections was present at the hearing and acknowledged that:

  1. He understood the Rule, and

  2. He did not contest the protest.

Rule 870 (3) provides that 'Any horse which breaks from its gait shall promptly regain its proper gait'.

The Breaking Horses Regulations (b) say 'Any horse which breaks from its gait within the final 200 metres of any race and continues on in the break for a distance of 50 metres or greater, shall be deemed to be breach of Rule 870(3) in that it has failed to promptly regain its proper gait'.

Submissions for Decision:

Using the films Mr Mulcay identified the horse ENHANCE YOUR CALM as the field entered the home straight. ENHANCE YOUR CALM was leading at the time. As the horses passed the 200 metres mark it went off stride, and galloped from there until the finish. Mr Mulcay added that he considered that the horse had galloped approximately 180 metres and hence was in breach of the Rule and Regulations.

Mr Mangos was present at the hearing and had nothing to add.

Reasons for Decision:

The Committee, after viewing the films and hearing the submissions, were satisfied that ENHANCE YOUR CALM had breached the Rule and Regulations.
