As Mr Dunn had admitted this breach it was found to be proved in accordance with Rule 1111(1)(d).

Mr Dunn was fined the sum of $200-00.

Facts:

Following the running of Race 2, the Cromwell Lake Dunstan Graduation Series (Final), an Information was filed by Stipendiary Steward Mr N. G. McIntyre against Open Horseman Mr D. J. Dunn, the driver of “Raging Bull” (9), alleging a breach of Rule 869(5), the “half carting” Rule.
The charge reads as follows.
“I the above named informant allege that the above named Respondent committed a breach of Rule 869(5) (in that) for some distance in the middle stages you half carted when driving Raging Bull.”
Rule 869(5) reads as follows,
“(5) A horseman shall trail with his horse’s head behind the seat of the sulky being trailed.”
Mr Dunn had indicated on the Information that this breach of the Rules was admitted and also that he did not wish to attend the hearing.

Submissions for Decision:

Mr McIntyre gave evidence and used video coverage to show that from about the 1400 metre mark Mr Dunn half carted for at least 200 metres before improving three wide.

Submissions for Penalty:

In relation to penalty Mr McIntyre advised that Mr Dunn had not previously breached this Rule and that the breach was admitted. Mr McIntyre referred to the Penalty Guide and submitted that a fine of $200-00 should be imposed in this case.

Reasons for Penalty:

We were satisfied that as Mr Dunn had not previously breached this Rule, and as it was admitted, that a fine of $200-00 should be imposed.
