As the horse was denied a fair start (in accordance with Rule 632) the judicial committee declared Pescatore to be a non-runner.
Facts:
Following the running of Race 6 the Kolla 1600m, the stewards requested a ruling in relation to Rule 632 in that Pescatore was denied a fair start.
632: If in the opinion of the judicial committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a race owing to the mechanical failure of the starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord) the judicial committee may declare such horse to be a non-starter.

Mr Walsh said that his horse (Pescatore) was a little difficult to load and when in the stall he had an assistant starter up beside him, that the assistant then let him go and moved away, as soon as he did that the horse shot backwards and got jammed against the back gate, the assistant then again took hold of the horse by the bridle. He said that the horse was then settled but unfortunately the start was made almost at the same time and as a result his horse was unable to jump on terms as it was still being held by the head. He said in his opinion the horse was denied a fair start and lost all chance. He added that he did not attach any blame on the barrier assistant as he was doing the best he could.
Mr McKenzie (Trainer of Pescatore) said that his horse has had barrier problems but went to a trial recently and behaved perfectly. He said he did ask Mr Phillips to give the horse some assistance. He said he believed that the assistant did have hold of the horse when the start was made.
The films clearly showed that at the time the start was made Pescatore was being held by the bridle and that this prevented the horse from jumping away on terms.
After viewing the films Mr Phillips (Starter) agreed that it looked like the horse was still being held when the start was made.
Mr Goodwin said that it was possibly a case of unfortunate timing, that it was a natural reaction for the assistant to grab the bridle and unfortunately the start was made almost at the same time. He said the stewards were of the opinion that the horse was denied a fair start.

The committee was satisfied that due to Pescatore being held by the bridle at the time that the start was made, the horse was prevented from beginning on terms and lost all chance.
