Decision:

As Miss Black had admitted this breach of the Rules it was found to be proved. 

Penalty:

We therefore suspended Miss Black’s Apprentice Jockey's license from the conclusion of racing on Friday 10 July 2015 until the conclusion of racing 24 July 2015 which encompasses the days racing at Oamaru on 19 July and Ashburton on 24 July 2015. In addition Miss Black is fined the sum of $300.

Facts:

Following the running of Race 8, the Phar Lap Charitable Trust Quiz Night R65, an Information was filed by Stipendiary Steward, Mr N Ydgren, against Apprentice Jockey, Miss R Black, the rider of MOONOFKLAIRESSA, alleging careless riding in that shortly after the start she allowed her mount to shift inwards when not clear of SWISS ALPS, ridden by J Lowry, which clipped a heel and blundered dislodging rider J Lowry.

“(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:

d) careless”

Miss Black had indicated on the Information that this breach of the Rules was admitted and she confirmed this at the hearing. Miss Black also agreed that she understood the charge and the Rule it was brought under. Miss Black was assisted at the hearing by Class A Rider, Miss S Collett. Mr Ydgren gave evidence and used video coverage to show that Miss Black, riding MOONOFKLARISSA, had drawn 13 at the barrier, with SWISS ALPS, ridden by Mr Lowry, drawn on her inner at barrier 12. Mr Ydgren stated that Miss Black had begun considerably better than Mr Lowry’s horse and as a result was approximately 1 length ahead of him over the initial stages. He said that after 100m Miss Black began to shift inwards when only a length clear causing Mr Lowry’s horse, who was placed to the inside of Miss Black’s horse's heels, to clip a heel and blunder dislodging Mr Lowry. Mr Ydgren stated that the carelessness in this incident was low end as the movement was minimal but the consequences were mid to high.

Miss Black, with the assistance of Miss Collett, stated that her horse had jumped awkwardly and the side of her foot had been crushed against the side of the gates. She said that she was in quite a bit of pain over the early stages which may have contributed to the incident. She also said that with the replays there was no way to tell if Mr Lowry’s horse had not been shifting out at the time of the incident which may have also contributed. Miss Black also believed that Mr Lowry could have ridden more prudently, realising that it was getting tight and easing slightly to avoid the situation before him.

Submissions for Penalty:

Mr Ydgren stated that Miss Black was predominately a South Island rider. Her record showed a 4 day suspension at Wellington on 6 December 2014 which was 8 months previous. Mr Ydgren submitted that Miss Black’s record could be regarded as good. Mr Ydgren stated that the JCA Penalty Guide recommended a starting point of 3 days suspension for a South Island ride for a breach of this rule. He said that Miss Black was entitled to credit for her admission of the breach and her good record. However the consequences of her carelessness were that a rider has been dislodged which, was a considerable aggravating factor. Mr Ydgren submitted that a suspension of 3 days be considered as penalty in this case.

Miss Black asked that a minimal suspension be imposed. She said that if she was suspended for 3 South Island days that would include the 1st day of National Week at Christchurch on 1 August which was a Premier Day. She added that she had several rides on that day including a ride in the Winter Cup. She submitted that consideration be given to a 2 day suspension as well as a fine. Mr Ydgren had no objection to a combination suspension and fine as penalty.

The matter of deferment was not considered as there were no South Island race days scheduled over the following 7 days.

Reasons for Penalty:

In determining penalty the Committee took into consideration all aggravating and mitigating factors. The JCA Penalty Guide provides a starting point of 3 days for a breach of this Rule for a South Island rider. Miss Black was entitled to a discount for her admission of the breach and her relatively good record. This discount we determined as 1 day. The Committee also determined that an uplift in penalty was required due to the consequences of her carelessness which we believed were mid to high. Normally this would add another 1 day to the penalty but after consideration the Committee believed the 3rd day being a premier day, was excessive in this case. We therefore determined that a combination 2 day suspension and a fine of $300 was appropriate in this case.
