After viewing the evidence and hearing the submissions of both parties the charge is found proved.

Facts:
Following the running of the Invercargill Licensing Trust Pace Mr B Williamson was charged with a breach of rule 869 (3) (b) in that he “… drove carelessly rounding the first bend when allowing his horse SANTANNA’S ROCKET to strike the sulky wheel of SPORTZSTAR which deflated in consequence.”
Mr Williamson attended the hearing. He understood the nature of the charge and admitted the breach.
Mr Wallis, with the aid of the video replays, pointed out the relevant positions of Santana’s Rocket and Sportzstar as the field entered the first bend. He stated Sportzstar was placed on the pole line with Santanna’s Rocket at the rear of the field. As the field left the turn and moved into the back straight Mr Williamson was observed to allow his horse to strike the wheel of Sportzstar. As a result the inside tyre of Sportzstar’s sulky deflated and Mr Walkinshaw retired the horse from the event soon after. He said this was careless driving on the part of Mr Williamson.
Mr Williamson stated he was at the rear of the field and took an opportunity to improve to the one-out line heading into the back straight. He had slapped his horse up to maintain the position. He said Santanna’s Rocket had responded and coupled with minor shifting of other runners had struck the wheel of Sportzstar.

Mr Wallis stated Mr Williamson was a very busy driver with 248 drives this season, he had had 541 last season. His last breach of this rule was in July last year. His record since was excellent and he had admitted the charge. He said the breach of the rule was in the mid to low range and was seeking a fine of $300.
Mr Williamson stated he had a very good record and had admitted the charge at the outset. It was an error of judgement on his part and accepted the penalty submissions put forward by Mr Wallis.
Reasons for Penalty:
Taking into account Mr Williamson’s excellent record and his admission of the breach a fine of $300 is appropriate.
