Therefore the committee declares SLIMLINE to be a starter in Race 7.

Facts:

Following the running of Race 7 (Midwest Disposals Handicap) Information A7673 was filed with the Judicial Committee. It sought a request for a ruling under the provisions of Rule 632. The Information stated: “Did SLIMLINE receive an opportunity for a fair start.”

Rule 632 states: (1) If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a Race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord), the Judicial Committee may declare such horse to be a non-starter.

Submissions for Decision:

Using the head-on film, Mr Whiterod identified that SLIMLINE was drawn to start from barrier six.

Stipendiary Steward Mr Goodwin used the film to submit that SLIMLINE’s gate opened in proportion with all other runners’ gates. He believed the committee needed to determine if the horse had it's head over the stalls when the start was affected.

The starter, Mr Phillips, said he was satisfied that he had the all clear from his assistants which then allowed him to proceed with initiating the start. He then advised the committee that he noticed that SLIMLINE had gone forward to jump, had then come back, then gone forward again and had dropped his head as Mr Phillips had affected the start.

Mr Tanaka, the rider of SLIMLINE, said that his horse charged at the gate prior to the gate opening. SLIMLINE then threw it’s head backwards and as the gates had opened had managed to position it’s head over the side of the stall as a result.

Mr Vile, the trainer of SLIMLINE, advised the committee that after viewing the head-on film he did not want to waste the Committee's time. He believed it was clear that his horse had it’s head on the side as the start was affected, and as a result he believed his horse did receive a fair opportunity to start.

Reasons for Decision:

The committee considered all of the submissions placed before it. SLIMLINE started from barrier six, and the head-on film is of significant assistance to the committee. It is very clear that the starter received the ‘all clear’ from his assistants and as he had proceeded to initiate the start, SLIMLINE had charged the gate. This resulted in the horse moving backwards, so that when the gates opened, SLIMLINE had moved its head sideways into the neighbouring stall. It is clear that there was no mechanical failure of the gates. It was also clear that there were no attendants holding the horse at time. On this occasion SLIMLINE has simply been the author of its own demise. Mr Vile is also to be commended for his honest and frank submission to the committee.
