As the breach was admitted we find the charge proved.

After considering all the above facts we impose a fine of $200.

Excessive use of the whip.

Facts:

Following race 7 an information was filed pursuant to rule 638(3)(b). The informant Mr M Williamson alleged that Mr C Lammas used the whip excessively on his mount PURR.

Submissions for Decision:

Mr Williamson demonstrated the video films which clearly showed Mr C Lammas riding PURR strike his mount approximately 11 times before the 200 metres.  Mr Williamson said altgough Mr Lammas did attempt to give his mount some respite he was in excess of the whip guidelines by not giving the required respite of 6 strides before resuming use of the whip. 

Mr Lammas in admitting the breach said it was obvious he had miscounted the number of strikes he was giving his mount.  However it was responding to the whip at the time and he thought his mount had a good chance of finishing in the money.

Submissions for Penalty:

Mr Williamson said Mr Lammas did incur a whip charge in Australia in the last 12 months but said their guidelines were in fact different from those in NZ.  He said the last time Mr Lammas had been charged in NZ under this rule was 12 months ago.  Mr Williamson submitted a fine not less than $200 would be appropriate.

Mr Lammas had no submissions to make regarding penalty.

Reasons for Penalty:

The committee considered all submissions and evidence before imposing an appropriate penalty.  As the Australian whip rules differ from our own we have disregarded the charge which Mr Lammas incurred in that country.  Other mitigating factors are Mr Lammas' admission of the breach and his good record under this rule in the last 12 months.  The committee does not consider 11 strikes of the whip a serious breach of this rule particularly when his mount was responding.  However on this occasion and by Mr Lammas' own admission he was clearly in breach of the whip guidelines.
