As Miss Wynne had admitted this breach of the Rules it was found to be proved.

Accordingly, Miss Wynne’s Class A licence was suspended from the conclusion of racing on 10 January up to and including 16 January 2018.
Facts:
Following the running of Race 10, the Vernan & Vazey Truck Parts Rating 65, an Information was filed by Stipendiary Steward, Mr M Davidson, against Class A Licensed Jockey, Miss S Wynne, the rider of RUBY ROW, in that she permitted her mount to shift inwards after the start, causing FERAL ICE, ridden by Mr K Mudhoo, to check.
Rule 638 provides:
“(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless”
Miss Wynne had indicated on the Information that this breach of the Rules was admitted and she confirmed this at the hearing. Miss Wynne also agreed that she understood the charge and the Rule it was brought under.
Mr Davidson gave evidence and used video coverage with the assistance of Stipendiary Steward, Mr J McLaughlin, to show that shortly after the start RUBY ROW, ridden by Miss Wynne, who had drawn 2 at the barrier, was racing on the outside of FERAL ICE, ridden by Mr K Mudhoo, who had drawn position 1 at the barrier.
Using the back straight films, Mr McLaughlin pointed out Miss Wynne riding forward shortly after the barriers were released and on the outside of Mr Mudhoo. Miss Wynne, he said, began to shift across the line of Mr Mudhoo to take up the lead position on the rail and was not clear causing Mr Mudhoo to check. The lateral film was produced which showed that Miss Wynne was barely a length ahead when shifting into the line of Mr Mudhoo.
Mr Davidson stated that FERAL ICE had overreacted which made the incident look worse.
Miss Wynne stated that she had ridden forward after the start and thought she was clear of Mr Mudhoo but clearly was not.
Submissions for Penalty:
Mr Davidson stated that the Stewards assessed the breach as low range. He said that Miss Wynne’s penalty record showed a breach of this rule on 16 March 2017 at the Amberley meeting where she received a 5-day suspension. Prior to this breach Miss Wynne had a number of breaches but over the past 9 months her record could be described as very good considering the number of rides she has had. He stated that the JCA Penalty Guide provided a 6-national day suspension for a low-level breach of this rule and submitted that he would leave it up to the Committee to determine an appropriate penalty.
Miss Wynne submitted that a 4-day suspension be considered as penalty in this case.
Deferment of penalty was discussed with Miss Wynne deciding to take the suspension as soon as possible which would be after the Westland meeting on Wednesday 10 January as rider declaration time had passed.
Reasons for Penalty:
The JCA Penalty Guide provides a starting point for a low-level breach of this rule of a 6-national day suspension. We agreed with the Stewards that the breach was at a low level and therefore adopted the 6-national day starting point. There were no aggravating factors to consider, therefore no increase in penalty was warranted.
Mitigating factors were Miss Wynne’s admission of the breach and her recent good record as described by Mr Davidson. For these factors we able to afford Miss Wynne a combined discount which we set at 1 day. The Committee therefore determined that a 5-national day suspension was an appropriate penalty in this case.
