Facts:

Following race 3 the informant Mr A Coles filed an information pursuant to rule 330 (3) (c).  He alleged that Mr M Cameron, rider of JUST JULIET, failed to make the contracted weight.

Submissions for Decision:

Mr Coles explained to the committee that Mr Cameron was engaged to ride JUST JULIET  at 54.5 kgs in race 3.  Prior to the race Mr Cameron approached the stewards and informed them he was going to be 1 kg over the carded weight.  Subsequently he was replaced.

Mr Cameron told the committee he had been on holiday but was confident of making the wieght prior to the races.  He admitted he had left it too late in trying to take off the extra kg.

Submissions for Penalty:

Mr Coles said Mr Cameron had incurred a fine of $100 under this rule at Ruakaka 1 week ago but this was mainly due to a misunderstanding between Mr Cameron and the connections of the horse.  Prior to this Mr Cameron had also incurred a fine at Taupo for the same offence last October.  Mr Coles submitted a fine of $200 would be appropriate.

Mr Cameron had nothing to add.

Reasons for Penalty:

The committee carefully considered all evidence and submissions as presented.  Mr Cameron's admission of the breach and his record were taken into account.  The committee explained to Mr Cameron that it was most important in future he was sure of making the contracted weight before accepting mounts.  The result from a breach of this rule always means inconvenience to connections and the betting public. The committee voiced its concern this was Mr Camerons 3rd charge in 12 months albeit one with strong mitigating factors.
