The protest was dismissed and the Judge's placing’s shall stand.

The Committee authorised the payment of stakes and dividends in accordance with its decision.

Facts:

Following the running of race 3, Preferment @ Brighthill Farm Concorde Handicap, an Information was filed Instigating a Protest pursuant to Rule 642(1). The Informant, Mr C Gibbs, Co Trainer of RIKKI TIKKI TAVI, alleged that VOLKS LIGHTNING or its rider placed 3rd by the Judge interfered with the chances of his horse placed 4th by the Judge.

The interference was alleged to have occurred in the final straight (100 metres).

The Judge's placing were as follows:

1st No. 14 ARDROSSAN

2nd No. 5 EVER LOYAL

3rd No. 3 VOLKS LIGHTNING

4th No. 6 RIKKI TIKKI TAVI

The official margin between 3rd and 4th was a neck.

Rule 642(1) states: “If a placed horse or its rider causes interference within the meaning of this rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with”.

All connections present acknowledged they understood the Rule.

Submissions for Decision:

The procedure for the hearing was explained to all parties present. The connections nominated the 2 people that would provide submissions on behalf of their horse.

Mr Gibbs submitted that VOLKS LIGHTNING moved out and took the running line of RIKKI TIKKI TAVI near the 100 metres. He said as a result Ms Costin had to severely adjust her riding and change ground. He said Ms Costin also had to stop riding and change her whip from one hand to the other.

Ms Costin said that she was making her run and was quite sure she was going to run past VOLKS LIGHTNING. She said VOLKS LIGHTNING directed her mount outwards and she had to stop riding and start again. She believed this cost her half a length.

Mr Cameron said it was clear on the video film that VOLKS LIGHTNING moved out near the 100 metres. He said that when Ms Costin changed her whip over to the other hand there was a clear margin between the 2 horses. He acknowledged that VOLKS LIGHTNING ran out but at the same time RIKKI TIKKI TAVI shifted in. He added that there was no contact between the 2 horses and RIKKI TIKKI TAVI had 75 metres to get past VOLKS LIGHTNING.

Mr Rogerson said that Ms Costin was her own length and one other length behind VOLKS LIGHTNING when she changed her whip over. He submitted that Ms Costin can’t use her changing of the whip as an excuse and RIKKI TIKKI TAVI had its chance to beat VOLKS LIGHTNING.

Mr Oatham on behalf of the Stewards said that in the lead up to the interference the films showed that RIKKI TIKKI TAVI was laying in and continued to lay in for some distance. He said that when VOLKS LIGHTNING shifted out it was sufficiently clear of RIKKI TIKKI TAVI and there was minimal interference. He concluded by saying that the Stewards do not support the protest.

Reasons for Decision:

The Committee carefully considered all of submissions presented and reviewed the video footage.

It was evident at the 100 metres that VOLKS LIGHTNING shifted out and hampered RIKKI TIKKI TAVI for approximately 2 strides. The head on film confirmed that RIKKI TIKKI TAVI had a tendency to lay in prior to the 100 metres. In our view the alleged interference was minor.

Having considered the degree of the interference, the manner in which both horses finished the race off and the neck margin at the finish the Committee is not satisfied that RIKKI TIKKI TAVI would have beaten VOLKS LIGHTNING.
