Mr Wright was fined $300.

Facts:

Following the running of race 6 (El Cheapo Cars 1200) Information No. A12286 was filed with the Judicial Committee. It was alleged by the Informant that Mr Wright used his whip excessively on THATZ LOUIE when the horse was out of contention.

Mr Wright said that he understood the Rule and the Whip Guidelines and confirmed that he admitted the breach.

Mr Balcombe identified THATZ LOUIE at the back of the field on entering the final straight on the film replays and said that Mr Wright continued to hit his horse when it was out of contention and there was not any chance of it finishing in the money.

Mr Wright said that his instructions were to “wake the horse up” but that he had followed the instructions too much.

Ms Clapperton said that the Trainer of the horse does give firm instructions to riders and that due to Mr Wright’s inexperience he had overdone the use of the whip.

Mr Goodwin said that Mr Wright had had 26 raceday rides and had a clear record. He placed the breach at the low-end.

There was not any comment from Mr Wright or Ms Clapperton regarding penalty.

Reasons for Penalty:

The JCA penalty starting point for a first breach of the Rule is for a $300 fine. Taking into consideration all matters pertaining to the charge it was determined by the Committee that a fine of $300 was a suitable penalty.
