As Ms Spratt admitted the breach we found the charge proved.

Penalty:

Ms Spratt, after speaking with her agent, advised us of her riding commitments within the next seven days. Taking this into account Ms Spratt is suspended from the close of racing on Wednesday October 9th up to and including racing on Friday October 18th. Race days in this period include:

10/10/13 Wairarapa

12/10/13 Matamata/Egmont

14/10/13 Paeroa

16/10/13 Whangarei

17/10/13 Woodville

18/10/13 Tauranga

We did not include race days at South Canterbury or Winton within this time period as it was our opinion that Ms Spratt was highly unlikely to ride at either of these meetings.

Charge:

Following the running of Race 6, the Group 2 DHL Hawke’s Bay Guineas, an Information was lodged by Mr R Neal alleging a breach of Rule 638(1) (d) in that Ms Spratt permitted her mount DONNIE BRASCO to shift inwards when not sufficiently clear of ALL DECKED OUT which was checked approaching the 1000 metres causing resultant interference to LUCKY FEATHER, TOUCHE and SIR ANDREW.

Facts:

Mr Oatham played the head on video which showed Ms Spratt angling her mount inwards from a wide draw. She came across  in front of Mr Cameron (ALL DECKED OUT) when only a bare length clear of that runner causing him to check backwards, which in turn caused interference to three more horses further back in the field. Ms Spratt also made the mistake of easing her mount when she got to the lead. Mr Oatham said, had she allowed it to roll forward, she may well have cleared Mr Cameron and the incident would not have happened.

Whilst Ms Spratt admitted the breach she told the committee that ALL DECKED OUT was over-racing and made the incident look worse than what it was. She said Mr Cameron was going to ease back anyway, and when she crossed in front of him, she thought she was clear.

Submissions for Penalty:

Mr Neal produced Ms Spratt’s riding record for the previous 12 months highlighting the following careless riding charges:

7/11/12                 4 days

Mr Neal said Ms Spratt readily admitted the breach recognising that she was not the required distance clear when crossing Mr Cameron. He said the interference was not severe with the Stewards considering it to sit mid-range. Mr Neal asked the committee to take into account the Group 2 status of the race and the fact that Ms Spratt is a very busy rider. He submitted that a suspension in the vicinity of 5 – 7 days was appropriate.

Ms Spratt thought she was a bit unlucky because Mr Cameron was always going to take a sit in behind, and the fact ALL DECKED OUT was throwing its head around made the interference worse than it might have been. In her opinion the breach was a minor one.

Reasons for Penalty:

In coming to a decision on penalty the committee took into account all of the submissions and adopted, as a starting point, a period of five days suspension. The fact that the race was of Group 2 status was considered an aggravating factor. Rule 920 (2) states:

On finding a breach proved the Judicial Committee may impose any penalty provided by these Rules. In imposing a penalty provided in these Rules the Judicial Committee may have regard to such matters as it considers appropriate including:

(a)   The status of the Race;

(b) The stake payable in respect of the Race;

(c)    Any consequential effects upon any person or horse as a result of the breach of the Rule; and/or

(d)  The need to maintain integrity and public confidence in racing.

Ms Spratt’s inward movement was gradual but unfortunately the consequences of her shift inwards resulted in four horses being affected to varying degrees. We therefore placed the degree of carelessness within the mid-range. We also took into account Ms Spratt’s ready admission of the breach, her forthright manner throughout the hearing and her good record. In our opinion, four careless riding charges incurred over a 12 month period by a busy rider is not unreasonable. After weighing up all of the factors we imposed a penalty of 6 days suspension of Ms Spratt's rider's license.
