Facts:

Mr Tidmarsh, Stipendiary Steward, alleged that Mr McIlwrick allowed FIERY FERRET to shift inside the marker line near the 200 metres of race 10, the SIR LINCOLN AT ALABAR NZ MOBILE PACE.

Rule 869 provides: “(7A) Every horseman who moves inwards shall ensure: (b) that any part of the sulky does not protrude inside the marker line.”

Mr Tidmarsh demonstrated that when improving his horse from wide on the track towards the pylons near the 200 metres mark, Mr McIlwrick allowed his horse to shift inwards striking one marker peg before racing inside the marker peg line and striking a second marker peg on entering the passing lane.

Submissions for Penalty:

Mr Tidmarsh produced Mr McIlwrick’s record. It was clear under this rule. He has had 188 drives this season and 387 last season, when he was still a junior horseman.

As the protest had been dismissed, the Stewards believed the consequences of the respondent’s actions were “virtually none”.

Reasons for Penalty:

The starting point in the Penalty Guide is a $200 fine or a 4-drive suspension. We have found that Mr McIlwrick has gained no advantage through his actions, but nevertheless he should have straightened his horse rather than allowing it to strike a peg and run inside another.
