Facts:
Following the running of Race 1 (Johnny Neil Building Ltd Maiden) an Information was lodged with the judicial committee alleging a breach of Rule 638(1)(d) in that Mr Turner allowed his mount PRINCESS PADOZA to shift out near the 300m and cause a check to BELLE ZED.
Rule 638(1)(d) reads:
A rider shall not ride a horse in a manner which the judicial committee considers to be careless.
The rule was read and Mr Turner and Mr Bourke acknowledged that they understood the rule and the charge.
All films were shown and Mr Goodwin said that near the 300m Mr Turner angled his mount out for a run when not clear of BELLE ZED and as a consequence BELLE ZED was checked and lost about one length. He added that contact was possibly made between the two runners.
Mr Turner said that he did angle out but did not hear a call until after he had pulled out and that his horse overreacted a little bit.
In answer to a question from the chair Mr Turner said that his horse had shifted out about three horse widths.
Mr Bourke chose to not make any comment.
Submissions for Penalty:
Mr Goodwin said that Mr Turner had not been charged with careless riding in over 12 months; hence his record was very good. He placed the carelessness below mid-range and submitted that a suspension was an appropriate penalty.
Mr Turner and Mr Bourke asked that if a suspension was to be imposed that it be started immediately as he (Mr Turner) did not have any riding commitments in the next few days.
Reasons for Penalty:
After careful consideration of the incident in its entirety the committee believed that the carelessness was in the mid-range category. Using the starting point of 5 days suspension a discount was given for Mr Turner’s very good record and his admittance of the breach and subsequently the committee determined that a 4 riding day suspension be imposed.
