“Lundqvist” is disqualified in terms of Rule 1003(2). The amended confirmed placings are as follows:-

1st Pippa Middleton (2)
2nd Chiltons Vocation (7)
3rd Mistress Castleton (13)
4th Imnotquitesure (11)
5th Above The Rest (5)

Authorisation is given for the payment of all dividends and stakes based on the amended decision.

Facts:

Following the running of race 3, the “Dusty and Denise Millar/Janet Phillips Memorial Handicap Trot” Information A7612 instigating a protest was filed by Stipendiary Steward Mr L Tidmarsh alleging a breach of Rule 870(3) and the Breaking Horse Regulations. The Information stated the protest was “on the grounds that “Lundqvist” broke passing the 60m and failed to settle finishing in 2nd place”.

Mr Hjalmarsson, the trainer of “Lundqvist” advised the Stewards prior to the hearing commencing that he did not contest the protest and did not wish to appear for the hearing.

The judge’s placings were:-

Rule 870 (3) states:-

Any horse which breaks from its gait shall promptly regain its proper gait.

The relevant extract from the Breaking Horse Regulations states:-

…Any horse which breaks from its gait within the final 200m of any race and continues on in the break for a distance of 50m or greater, shall be deemed to be in breach of Rule 870(3) in that it has failed to promptly regain its proper gait.

…Where a protest has been duly lodged against the placing of an offending horse, the Judicial Committee shall either ……disqualify it from the race under Rule 1003(2).

The relevant extract from Rule 1003(2) states:-

Every horse which commits a breach of any Rule shall be liable to the following penalties:-

(a) to be disqualified or scratched from any race……

Submissions for Decision:

Mr Tidmarsh showed the side-on film of the last 200m of the race. He identified “Lundqvist” running second and breaking free of interference just prior to the 60m mark and continuing on in that break until the finish line. He said the Stewards were asking for the horse to be disqualified in terms of Rule 870(3), the Breaking Horse Regulations and Rule 1003(2).

Reasons for Decision:

The film of the final 200m of the Race clearly shows “Lundqvist” breaking free of interference just prior to the 60m mark and continuing in a break until the finish line and therefore being in breach of Rule 870(3) and the Breaking Horse Regulations.
