Facts:
Following the running of Race 3 (Lyndhurst Farm 1400) Information A14016 was filed with the Judicial Committee. It was alleged by the Informant that Ms Newman the Rider of COMME BELLA FILLE had permitted her mount to shift in near the 150m when not sufficiently clear of LADY TELENA which was checked.
Ms Newman who was assisted by Mr Harris said that she understood the Rule, the charge and confirmed that she admitted the breach.
All film replays were shown and Mr Williamson said that Ms Newman and her mount had been racing 3-wide and then shifted in onto the line of LADY TELENA who was checked. He said that Ms Newman was about ¾ length in front of LADY TELENA when shifting. Mr Williamson added that the runner to the inside of LADY TELENA shifted out a little and that it could be a mitigating factor and that Ms Newman’s mount was finishing quickly.
To summarise, Ms Newman and Mr Harris said that Ms Newman was watching the horse directly in front of her and that it was misjudgement on her part. They also believed that the inside horse dictated LADY TELENA out.
Submissions for Penalty:
Mr Jones said that Ms Newman’s record showed two prior suspensions for careless riding, those being on 5 September 2020 (4-Riding Days Suspension) and 11 December 2020 (3-Riding Days Suspension + $500 Fine).
Mr Jones added that he placed the careless riding in the mid-range area and that Mr Grylls (LADY TELENA) had been in a dangerous position. He said that Ms Newman had gone on and won the race.
Mr Harris said that Ms Newman’s riding had really improved and that she had won 4 races in the past fortnight. He asked that the Committee take into account Ms Newman is an Apprentice and that the inside runner had shifted out.
Ms Newman has riding commitments through to the end of racing on 17 February.
Reasons for Penalty:
The film evidence showed very clearly that Ms Newman let her mount shift into the line of LADY TELENA when only ¾ length clear. The consequence of her shift was that Mr Grylls had to take very sharp evasive action to avoid the heels of Ms Newman’s mount.
Whilst there was some minor movement from the inside, this had very little effect on the interference that took place.
The Committee placed the careless riding as no less than mid-range. Credit was not given for the record or the admitted breach, as the interference was relatively severe and Ms Newman’s mount went on to win the race.
The JCA Penalty Guideline for mid-range carelessness is 5-Riding Days Suspension together with a $500 Fine. Taking all matters into consideration it was determined that the penalty starting point was the appropriate sanction to impose.
