As Mr Nolan admitted the breach we find the charge proved.

Accordingly, we impose a $150 fine.

Charge:

Following race 1, an information was filed pursuant to Rule 605(1). The informant, Mr Williamson, alleged that Mr Nolan failed to arrive on course by the required time, being replaced on his declared ride COOL LADY.

Facts:

Mr Williamson informed the committee that Mr Nolan had contacted a fellow rider in Mr J Collett and advised him that he would be late to arrive on course. Mr Collett then forwarded the message onto Mr Williamson.

Mr Nolan informed the committee that he was currently unlicensed and was relying on fellow riders for transport to the races. He said he was remorseful in letting himself and connections down, however realising it was his own fault.

Submissions for Penalty:

Mr Williamson produced Mr Nolan's record which showed no previous breaches of this rule in the last 12 months. He submitted that an appropriate penalty under the circumstances was a fine of $100.

Mr Nolan when asked for submissions on penalty had nothing to say.

Reasons for Penalty:

The committee carefully considered all the evidence and submissions presented. The mitigating factor is admission of the breach and his very good record. However, this has to be balanced against the fact that Mr Nolan let himself and connections down by arriving late on course.

Before imposing penalty the committee referred to the JCA penalty sheet. This showed that recent penalties under this rule had a $200 fine imposed. Taking into account Mr Nolan's personal circumstances this committee believes an appropriate penalty is $150.
