As Mr Goindasamy admitted the breach we found the charge proved.

Taking into account Mr Goindasamy’s upcoming riding commitments we approve his request for a deferment of penalty in terms of Rule 1106(2) and suspend his license from the close of racing on Wednesday October 31st up to and including racing on Thursday November 6th.
Facts:
Following the running of Race 7 (Savvy Coup Do It for Michael Premier), an Information was lodged by Mr N Goodwin stating that “Apprentice, A Goindasamy allowed his mount to shift inwards when not clear of BRING TO THE BLOCK and GET SCHROEDER who were checked near the 1100m”.
Mr Goindasamy is apprenticed to Mr R Manning but was assisted in today’s hearing by Mr R Hannam.
Mr Goodwin explained the incident with the assistance of the available videos and began by showing the start with Mr Goindasamy drawing barrier no. 14. Shortly after the start, in an attempt to get a better position closer to the rail, Mr Goindasamy angled his mount in sharply. To his inside he cleared the mount of Mr Tim Johnson but as he continued inwards he was not clear of Ms Hemi (BRING TO THE BLOCK) who had to take a hold of her mount and GET SCHROEDER (Mr Parkes) who was checked.
Mr Goindasamy explained that he was looking for cover after jumping from a wide barrier draw and he did not see the two horses inside of him. He thought they must have hunted up quite quickly because he was looking but did not notice them as he moved inwards towards the rail.
Submissions for Penalty:
Mr Goodwin told the Committee that Mr Goindasamy incurred a lengthy suspension in May this year at only his second race-day ride but since then he has had more than 60 rides without incident. He said the Stewards placed the degree of carelessness just below midrange and submitted that a suspension was an appropriate penalty.
Mr Goindasamy advised the Committee that he had riding commitments on Wednesday October 31st at Waipa.
Reasons for Penalty:
In coming to a decision on penalty the Committee considered all submissions. The films were quite clear and showed Mr Goindasamy moving quickly across from a wide barrier draw towards the rail. He could be seen looking to his inside a number of times. The side-on film confirmed that, while he safely cleared the runner to his immediate inside, he was not the required 2 lengths clear when he took the line of the two affected runners. Mr Goindasamy had been instructed to get cover and was attempting to do so. He was also trying to do so safely, as evidenced by his looking inwards, but unfortunately he failed to see the two runners coming up to his inside. This was no doubt due to his inexperience.
While the interference may not have been severe the incident affected two runners. We placed Mr Goindasamy’s carelessness in the low-mid range.
Mitigating factors were his ready admission of the breach and his good record. The Committee adopted a starting point of 7 days and after balancing all factors, including Mr Goindasamy’s apprentice rider status and relative inexperience, we deemed that a six day suspension was an appropriate penalty.
