Meet Title:
Counties RC - 21 October 2016

Meet Chair:
NMcCutcheon

Meet Committee Member 1:
RSeabrook

Race Date:
2016/10/21

Race Number:
R 5

Decision:

As the charge was admitted it was deemed to be proved.

Penalty:

Ms Jones licence to ride in races was suspended from the end of racing on 27 October 2016 up to the cessation of racing on 4 November 2016 (4 riding days).

The 4 days being:
Tauranga - 29 October
Auckland - 1 November
Waipa - 2 November
Rotorua - 4 November

Facts:

Following the running of R5 (Mount Shop 1200), Information A7887 was filed with the Judicial Committee. It was alleged that A Jones, the rider of OUR DAISY allowed her mount to shift in when not sufficiently clear of SONO VELOCE which was dictated into the line of HUNAPO which was checked.

Rule 638(1)(d) provides:
A rider shall not ride a horse in a manner which the Judicial Committee considers to be:
   careless

Ms Jones said that she understood the Rule, the charge and confirmed that she admitted the breach and did not want any assistance.

Mr Williamson showed all film replays and identified OUR DAISY racing 3-wide, to its inside was SONO VELOCE and to the inside of that runner was HUNAPO. Mr Williamson said that near the 1000m Ms Jones let her mount shift down onto SONO VELOCE who in turn tightened HUNAPO who received a severe check.

Ms Jones, for her part, said that she looked and only saw SONO VELOCE to her inside but when made aware that another horse was inside that runner, she attempted to ride forward to clear the inside horses, but that it was too late. She said that she agreed with the Stipendiary Steward’s interpretation of the incident.

Submissions for Penalty:

Mr Coles said that Ms Jones had a very good record, with the last suspension being imposed on 19 December 2016 when a 3-day suspension was imposed. He said that the Stipendiary Stewards placed the carelessness in the mid-range category.

Ms Jones said that she was a little unlucky in that she was initially unaware that HUNAPO was racing back inside SONO VELOCE. She added that her record, as given by the RIU, was correct and that if she was to be suspended, she would like it to start after the Taranaki meeting on 27 October 2016.

Reasons for Penalty:

The committee deemed the carelessness to be no less than mid-range. The aggravating factor was that HUNAPO suffered a sharp check and lost some lengths. The JCA starting point for careless riding is a suspension of 5 riding days. Giving credit for the admission of the breach and very good record, the committee determined that a 4 riding day suspension was an appropriate penalty.
