Accordingly, pursuant to Rule 648 (3) the Committee exercised its discretion and declared that ARMAGUARD be disqualified from the race.
Facts:
Following the running of Race 5, Fortuna – Melody Belle, a Request for a Ruling was filed with the Judicial Committee pursuant to Rule 648(3). The Informant Mr J Oatham, Chief Stipendiary Steward, alleged that ARMAGUARD’S rider weighed in 0.8 kg under his weigh out weight.
Mr Ralph, the trainer of ARMAGUARD, acknowledged that he understood the Rule and confirmed he admitted the breach.
Rule 648(3) provides If, on being weighed in, a Rider cannot draw the proper weight (meaning thereby the weight allotted by the Handicapper for his horse to carry and adjusted only by any re-handicap, by having been declared overweight, by penalty or by authorised allowance) the Clerk of the Scales shall allow such rider 0.5 kg and if the allowance is not sufficient to enable the proper weight to be drawn then subject to sub-Rule (4) of this Rule then in addition to any other penalty which may be imposed the horse shall be disqualified for the Race.
Submissions for Decision:
Mr Oatham advised the Committee that Mr Goindasamy, the rider of ARMAGUARD, weighed in 0.8 kg under his weigh out weight. He said Stipendiary Steward, Mr Robinson, found a large towel which had been part of the riding gear weighed out with, had not been placed on the horse when saddling. Mr Robinson found the large towel on the back wall in the tie up stalls. The towel was produced as an exhibit at the hearing.
Mr Oatham said that ARMAGUARD finished in 6th place and submitted the horse should be disqualified from the race. He added that it was fortunate that no bets types were involved given the 6th placing of ARMAGUARD.
Mr Ralph admitted that he left the towel on the back wall when saddling up ARMAGUARD.
Reasons for Decision:
The Committee carefully considered the submissions presented and was satisfied that Mr Goindasamy, the rider of ARMAGUARD weighed in 0.8 kg under his weigh out weight. It is significant that Mr Ralph did not dispute that his horse weighed in 0.8 kg light as a result of his neglect in saddling.
The Committee notes that ARMAGUARD was placed 6th by the Judge and the Rule is specific in that the horse shall be disqualified from the race.
